WHEREAS, in order to insure the widening of that portion
of Collins Avenue lying westerly of and adjacent to Lots 1 to 30,
inclusive, and Lot 231 of First Ocean Front Subdivision, according
to the plat thereof, recorded in Plat Book 9, page 78 of the public
records of Dade County, Florida, it was necessary for the City of
Miami Beach to arrange for conveyances, for highway purposes, to said
City by the owners thereof of the outlots lying between Collins Avenue
and Indian Creek opposite to said Lots 1 to 30, inclusive, and Lot
231, and being similarly numbered, and to procure deeds from the
Trustees of the Internal Improvement Fund of the State of Florida
to said owners conveying areas of submerged land in Indian Creek to
be filled by the City in exchange for the existing outlots herein-
before mentioned; and
WHEREAS, the said owners have placed with the City Clerk
in escrow grants of easement so that the City can construct and
maintain storm sewers in, over, under and across said filled areas,
said grants of easement and rights of way to be delivered when the
filling, now in process, of said submerged area has been substantially
completed; and
WHEREAS, it now becomes necessary for the City to assign
to the State of Florida, for the use and benefit of the State Road
Department of Florida, the easements and rights of way so granted
by the owners as aforesaid; and
WHEREAS, the Attorney for the City has prepared an assignment
of the said easements and rights of way, with the terms of which the
• members of the City Council are familiar;
NOW, THEREFORE, BE IT RESOLVED by the CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City Clerk be
and they are hereby authorized and directed to execute said assignment
in the name of and on behalf of said City and, after the execution
thereof, to place the same in escrow with the City Clerk, to be delivered
to the said State Road Department of Florida when the City Engineer
shall certify that the filling hereinbefore referred to has been
substantially completed.
