RESOLUTION NO° 10999
WHEREAS: a number of owners of property in Block One of First
Ocean Front Subdivision have appeared before the City Council of
the City of Miami Beach, Florida requesting that the right of way
for that portion of Collins Avenue (a portion of State Road AlA)
abutting upon Lots Two (2) to Fourteen (14) : of said Block One: be
re-located by moving said right of way westerly a distance of ten
(10) feet: more or less, and
WHEREAS, said request is not without merit, inasmuch, among
other things: such re-location of said right of way will reduce
the curve thereof in the vicinity of said Lots Two (2) to Fourteen
(14) , inclusive:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Miami Beach: Florida, that the City Council approves the said
request and recommends to the State Road Department and to the
Trustees of the Internal Improvement Fund: that the said change be
made, provided, however, and on the conditions that:
1. That the said property owners procure formal assurances
from the State Road Department and the Trustees of the Internal
Improvement Fund that neither agency objects to such re-location,
and further that formal assurances be procured from the State Road
Department that the funds allocated for the widening of Collins
Avenue will not be delayed or jeopardized in any way and that no
delay in the commencement of said widening project will be entailed;
and
2. That the City shall not bear any additional cost, if any,
of modifications in engineering and construction plans occasioned
by the proposed re-location; and
3. The delivery to the City Council of a formal determination
by the State Road Department whether immediate construction of
bulkheads in Indian Creek in the area of the proposed re-location
will be required.
