Resolution 11245 RESOLUTION NO. 11245
WHEREAS on the 9th day of September, 1958, Malachi J.
Garvey, a Police Department employee of the City of Miami Beach,
was injured as the result of a Workmen' s Compensation accident,
and
WHEREAS the City of Miami Beach, under the provisions
of the Workmen' s Compensation Law, furnished Workmen's Compensa-
tion and medical benefits to the said Malachi J. Garvey in the
sum of $236. 35, and
WHEREAS the said Malachi J. Garvey instituted suit
against one Leo Isadore Langer, as the third party whose negli-
gence caused the said accident of September 9, 1958, and
WHEREAS the Judge of the Circuit Court determined that
the pro rata share of the Workmen's Compensation benefits paid by
the City of Miami Beach constituted a lien in the sum of $75.00
against the amount recovered by Judgment against the said third
party, and
WHEREAS the City Attorney has prepared a Satisfaction
of Lien for the said $75.00 with the terms of which the City
Council is familiar, and
WHEREAS it is deemed to be in the best interest of the
City of Miami Beach to satisfy the said lien,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City
Clerk be and they are hereby authorized and directed to execute
the said Satisfaction of Workmen' s Compensation Subrogation Lien
in the name of and on behalf of the said City.
