Resolution 11506 RESOLUTION NO. 11506 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, CALLING AN ELECTION AT WHICH THERE SHALL BE SUBMITTED TO A VOTE THE MATTER OF ISSUANCE OF BONDS OF SAID CITY IN THE SUM OF $12, 569,000.00 FOR THE PURPOSES IN THIS RESOLUTION STATED. WHEREAS , the City Council of the City of Miami Beach, Florida, deems it advisable to issue bonds of said City in amounts and for the municipal purposes set forth in the elec- tion notice provided for in Section 6 of the following resolution. NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 . That, subject to the authorization of the duly registered and qualified voters of said City, who are freeholders therein, participating in the election according to law, which is hereinafter called, negotiable coupon bonds of the City of Miami Beach, Florida, shall be issued in the sums and for the purposes stated in the Notice of Election provided in Section 6 of this resolution. SECTION 2 . That a special election is hereby called and directed to be held in the City of Miami Beach, Florida, from 7 : 00 o' clock A. M. until 7: 00 o'clock P .M. on the 1st day of June, A.D. 1965, for the purpose of sub- mitting to a vote of the duly registered and qualified voters of said City who are freeholders therein the questions whether bonds of said City shall be issued in the sums and for the purposes stated in the Notice of Election provided for in Section 6 of this resolution. SECTION 3 . That the City Clerk, who is also the Supervisor of Registration, open the books of said City from 9:00 o'clock A.M. until 5: 00 o'clock P.M. each day, Sundays and Holidays excepted, from April 22, 1965 to May 1, 1965, both inclusive, for the purpose of registering those electors who are qualified to register for this election, and after said May 1, 1965, no elector shall be registered for said election. SECTION 4. For the purpose of holding and conducting said election, the City of Miami Beach has been divided into voting precincts or election districts with polling places therein, as follows: -1- PRECINCT NO, 58:: Beginning at the intersection of the west boundary line of the City of Miami Beach with the easterly extension of the south line of Section 5-53-42 (center line of N.E. 87th Street, Miami) , run southeasterly to a point on the center line of Normandy Waterway where said center line intersects the west shore line of Normandy Isle, thence run easterly along the center line of Normandy Waterway to its intersection with the center line of Indian Creek; thence run northwesterly along the center line of Indian Creek to its intersection with the center line of Tatum Waterway; thence run northeasterly and northerly along the center line of Tatum Waterway and its extension northerly to its intersection with the north boundary of the City of Miami Beach (87th Terrace) ; thence run West along the North boundary of the City of Miami Beach to its intersection with the West boundary of the City of Miami Beach; thence run southwesterly along the west boundary of the City of Miami Beach to the point of beginning; the Polling Place of which shall be at the Biscayne Elementary School, situated at 800 - 77th Street PRECINCT NO. 59 :. PRECINCT NO. 82 : Bounded on the north by the center line of West 51st Street (City of Miami Beach) and its easterly and westerly extension along section lines ; bounded on the south by the center line of Biscayne Waterway, from its intersection with the center line of the westerly extension of West 34th Street, westerly to the eastern shore line of Biscayne Bay, thence due west to the west boundary line of the City of Miami Beach; bounded on the east by the center line of Biscayne Waterway, from its intersection with the center line of West 34th Street extended west, to its inter- section with the south shore line of Surprise Lake; thence run easterly and northeasterly along the south shore line of Surprise Lake to its intersection with the center line of Flamingo Waterway; thence run northeasterly along the center line of Flamingo Waterway to its intersection with the center line of Indian Creek, thence run north along the center line of Indian Creek to its intersection with the center line of West 51st Street extended east; bounded on the west by the west boundary line of the City of Miami Beach, the Polling Place of which shall be at the Nautilus Junior High School, 0 situated at 4301 N. Michigan Avenue PRECINCT NO, 108: Bounded on the north by the center line of Biscayne Waterway and its extension due West to the intersection with the west boundary of the City of Miami Beach; bounded on the east by a line described as follows: Beginning at the intersection of the center line of Alton Road with the above mentioned center line of Biscayne Waterway, run southerly along the center line of the said Alton Road to the center line of Dade Boulevard; thence run southwesterly along the said center line of Dade Boulevard to the eastern shoreline of Biscayne Bay; thence run southerly meandering the eastern shoreline of Biscayne Bay to the center line of 14th Street; bounded on the south by a line described as follows . PRECINCT NO. 111 : Bounded on the north by the center line of Dade Boulevard (City of Miami Beach) ; bounded on the south by the center line of 14th Street from the eastern shore line of Biscayne Bay East to the center line of Bay Road, thence north along the center line of Bay Road to its intersection with the center line of 15th Street, thence east along the center line of 15th Street to its intersection with the center line of Meridian Avenue ; bounded on the east by the center line of Meridian Avenue; bounded on the west by the eastern shore line of Biscayne Bay, the Polling Place of which shall be at the Greater Miami Jewish Community Center, situated at 1536 Bay Road. PRECINCT NO. 112 : Bounded on the north by the center line of 14th Street (City of Miami Beach) from the eastern shore line of Biscayne Bay east to the center line of Bay Road, thence north along the center line of Bay Road to the center line of 15th Street, thence east along the center line of 15th Street to the center line of Meridian Avenue; bounded on the south by the center line of 11th Street and its extension westerly; bounded on the east by the center line of Meridian Avenue; bounded on the west by the eastern shore line of Biscayne Bay, the Polling Place of which shall be at the Activities Building situated in Flamingo Park at 12th Street and Michigan Avenue. PRECINCT NO. 113 : Bounded on the north by the center line of 15th Street and its extension easterly; bounded on the south by the center line of 11th Street and its extension easterly; bounded on the east by the eastern boundary of the State of Florida; bounded on the west by the center line of Meridian Avenue, the Polling Place of which shall be at the Fire Station in the City Hall Building, situated at 12th Street and Washington Avenue. PRECINCT NO. 114: Bounded on the north by the center line of 11th Street and its extension easterly; bounded on the south by the center line of 7th Street and its extension easterly; bounded on the east by the eastern boundary of the State of Florida; bounded on the west by the center line of Meridian Avenue, the Polling Place of which shall be at the Oceanfront Auditorium, situated at 10th Street and Ocean Drive. -4- PRECINCT NO, 115 ; Bounded on the north by the center line of 11th Street (City of Miami Beach) and its extension westerly; bounded on the south by the center line of 7th Street, from the center line of Meridian Avenue west to the center line of Alton Road, thence south along the center line of Alton Road to the center line of 6th Street; thence west along the center line of 6th Street and its westerly extension to the eastern shore line of Biscayne Bay; bounded on the east by the center line of Meridian Avenue; bounded on the west by the eastern shore line of Biscayne Bay, the Polling Place of which shall be at the Miami Beach Employees Benevolent Association Building, located at 920 Alton Road. PRECINCT NO. 116: Bounded on the north by the center line of 7th Street (City of Miami Beach) and its easterly production, from the eastern boundary of the State of Florida westerly to the center line of Alton Road, thence south along the 1 center line of Alton Road to the center line of 6th Street, thence west along the center line of 6th Street and its westerly production to the eastern shore line of Biscayne Bay, thence northerly meandering the eastern shore line of Biscayne Bay to the center line of 14th Street, thence westerly along a straight line running from the center line of 14th Street at the eastern shore line of Biscayne Bay to a point on the west boundary line of the City of Miami Beach 1500 feet southwesterly, as measured along the western boundary line of the City of Miami Beach, from the intersection of the west boundary line of the City of Miami Beach and the center line of the Venetian Causeway; bounded on the south by the center line of 3rd Street (City of Miami Beach) and its easterly production, from the eastern boundary of the State of Florida westerly to the center line of Alton Road, thence northwesterly along the center line of Alton Road to the intersection with the south line of Lot 32 , Block 111, Ocean Beach Addition Noo 3, as recorded in Plat Book 2 at page 81 of the public records of Dade County, Florida, produced northeasterly, thence southwesterly along the south line of said Lot 32 and its production to the eastern shore line of Biscayne Bay, thence northwesterly along the eastern shore line of Biscayne Bay to the center line of MacArthur Causeway, thence westerly along the center line of MacArthur Causeway to the western boundary line of the City of Miami Beach; bounded on the westerly side by the western boundary of the City of Miami Beach, the Polling Place of which shall be at South Beach Elementary School, situated at 335 Lenox Avenue. PRECINCT NO. 148: Bounded on the north by the center line of 3rd Street (City of Miami Beach) and its easterly production from the eastern boundary of the State of Florida westerly to the center line of Alton Road, thence northwesterly along the center line of Alton Road to the intersection with the south line of Lot 32, Block 111, Ocean Beach Addition No. 3, as recorded in Plat Book 2 , at page 81 of the public records of Dade County, Florida, produced northeasterly, thence southwesterly along the south line of said Lot 32 and its production to the eastern shore line of Biscayne Bay, thence northwesterly along the eastern shore line of Biscayne Bay to the center line of MacArthur Causeway, thence westerly along the center line of MacArthur Causeway to the western boundary line of the City of Miami Beach ; bounded on the south by a straight line running southeasterly from the intersection of the center line of South East 8th Street (City of Miami) and the western shore line of Biscayne Bay to a point in Norris Cut halfway between the most southerly point on Fishers Island and the most northerly point on Virginia Key; bounded on the east by the eastern boundary line of the State of Florida; bounded on the west by the western boundary line of the City of Miami Beach, the Polling Place of which shall be at the South Shore Park Recreation Center Building, situated at 930 Biscayne Street. -5- All being places where elections are usually held in said municipality. All electors shall vote at the Polling Places in the voting precincts in which the City Registration Books show that said electors reside . SECTION 5 . That Thirty days ' notice of said election shall be given by publication in the Miami Beach Sun, a newspaper published in the City of Miami Beach, Florida. Such publication shall be made at least once each week for four consecutive weeks during said period of thirty days . SECTION 6. That the Notice of Election shall be substantially in the following form: "CITY OF MIAMI BEACH, FLORIDA NOTICE OF SPECIAL ELECTION. NOTICE IS HEREBY GIVEN that an election has been called by the City Council of the City of Miami Beach, Florida, and will be held in said City from 7:00 o' clock A. M. until 7: 00 o' clock P . M. on the 1st day of June, A. D . 1965, at which there shall be submitted to the duly registered and qualified voters of said City who are freeholders therein the following questions: 1. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $1, 095, 000 .00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of MAKING IMPROVEMENTS to the existing GRAVITY SANITARY SEWER SYSTEM? 2 . Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $465, 000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of MAKING IMPROVEMENTS to the existing SANITARY SEWER FORCE MAIN SYSTEM? 3 . Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $700, 000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of REPLACING PORTION OF THE WATER SUPPLY MAIN on the VENETIAN CAUSEWAY from Miami to Miami Beach and CONSTRUCTING EXTENSION to the WATER SUPPLY SYSTEM? 4 . Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $840, 000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of CONSTRUCTING STORM SEWERS throughout the City? 5 . Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $36, 000 .00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the payment of all or part of which a -6- special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assessments made against abutting property, as authorized by law, for the purpose of PAVING the fol- lowing courts: Between Collins Avenue and Harding Avenue from 77th Street to 79th Street, from 80th Street to 81st Street, from 82nd Street to 87th Street; The Courts between Alton Road and Michigan Avenue from 3rd Street to 4th Street; The Court betwen Michigan and Jefferson Avenue from 2nd Street to 3rd Street; The Court between 71st Street and Biarritz Drive from Rue Versailles to Rue Vendome? 6. Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $149,000 .00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the payment of all or part of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assessments made against abutting property, as authorized by law, for the purpose of PAVING, (IN- CLUDING SIDEWALKS AND STREET LIGHTING) the following highways: Lincoln Road from West Avenue to Biscayne Bay; Bay Road from Lincoln Road to approximately 150 ' South of 15th Street; Island Avenue South of Venetian Way; Biarritz Drive from Calais Drive to Normandy Drive? 7 . Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $23, 000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the payment of all or part of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assessments made against abutting property, as authorized by law, for the purpose of PAVING, (IN- CLUDING SIDEWALKS) the following highways: West 40th Street from Garden Avenue to North Meridian Avenue; (Sidewalks only) North Meridian Avenue from West 39th Street to West 41st Street? 8. Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $66,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the payment of all or part of which a special annual tax will be levied, the amount of which levy will be reduced by collections from special improvement assessments made against abutting property, as authorized by law, for the purpose of PAVING the following highways: West 39th Street from Garden Avenue to North Meridian Avenue; North Jefferson Avenue from West 41st Street to West 42nd Street 16th Street from West Avenue to Bay Road; 9th Street from Alton Road to West Avenue; 10th Street from Alton Road to West Avenue; 11th Street from Alton Road to West Avenue; 12th Street from Alton Road to West Avenue; 19th Street from Washington to James Avenue?' -7- 9. Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $320, 000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of RECONSTRUCTING 11th Street from Meridian Avenue to Alton Road; 15th Street from Alton Road to Bay Road; North Bay Road from 20th Street to Alton Road at Chase Avenue; North Coconut Lane and South Coconut Lane? 10 . Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $300, 000.00 with interest at a rate to be hereafter determined not exceeding 4% per annum, for the purpose of LENGTHENING the existing FISHING PIER AT BISCAYNE STREET IN THE ATLANTIC OCEAN? 11. Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $1, 500, 000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of CONSTRUCTING A PUBLIC PARK ON THE OCEAN FRONT extending from Collins Avenue to the Atlantic Ocean and located BETWEEN 76th STREET AND 79th STREET? 12 . Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $3, 000, 000 .00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of CONSTRUCTING A PUBLIC PARK ON THE OCEAN FRONT extending from Collins Avenue to the Atlantic Ocean and located BETWEEN 81st STREET AND 87th STREET 13.. Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $2, 000,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of PROVIDING TV STUDIO AND COMMUNITY FACILITIES % 14. Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $280, 000.00, with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing a new Fire Station, including a Pumper of 750 gallons per minute capacity? 15. Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $750,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of relocating the City Yards now located at Alton Road and 2nd Street ? 16. Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $540, 000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of widening Pine Tree Drive from 51st Street to 63rd Street, including Curb, Gutter and Parkway? -8- 17 . Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $125, 000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, to supplement available funds, for the pur- pose of constructing a Baseball Grandstand in Flamingo Park? 18. Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $65, 000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing a Vehicular Bridge from Park View Island to Tatum Waterway Drive? 19 . Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $100, 000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of moving the Park Department Nursery from the Old Municipal Golf Course to Bayshore Golf Course? 20 . Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $120,000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of constructing Irrigation Systems at Normandy Shores and Bayshore Golf Courses? 21. Shall the City of Miami Beach, Florida issue negotiable coupon bonds in the amount of $95, 000.00 with interest at a rate to be hereafter determined, not exceeding 4% per annum, for the purpose of landscaping the Interchange and the easterly end of Julia Tuttle Causeway? For the purpose of holding and conducting said election the City of Miami Beach has been divided into voting precincts or election districts with Polling Places therein as follows: (Herein set forth precincts and Polling Places as specified in Section 4 hereof) . -9- All being places where elections are usually held in said munici- pality. All electors shall vote at the Polling Places in the voting pre- cincts in which the City Registration Books show that said Electors reside. The voting shall be on voting machines . The Registration Books will be open from Nine o'clock A. M. until Five o'clock P. M. each day, Sundays and Holidays excepted, from April 22, 1965 to May 1, 1965, both inclusive, for the registra- tion of persons qualified to register for said election. (Signed) Melvin J. That the collections upon the special improvement assessments against abutting properties shall be deposited in the City' s local improvement bond fund for appli- cation to interest and principal payments on the bonds hereby authorized and hereafter to be sold for the purpose of paying in the first instance the cost of said improvements . SECTION 14. That a special annual tax upon all taxable property within the City of Miami Beach, over and above all other taxes authorized or limited by law, or by the Charter of the City, sufficient to pay the interest and the principal of the bonds hereby authorized, at their several dates of maturity, shall be and is hereby levied, provided that the amount of such special annual tax levy shall be reduced by the amount then contained in the local improvement bond fund, and by the amount of special improvement assessments collected and then remaining in the local improvement bond fund, and by the amount of any other funds applicable to said bonds . SECTION 15 . That the special improvement assessments against abutting property herein provided for, for highway and sidewalk improvements and street lighting, are hereby pledged for the payment of principal and interest of the bonds hereby authorized for theur ose of such highway and sidewalk improve- ments ments and the proceeds of the special annual tax hereby provided for shall be used for no other purpose than the payment of principal and interest of the bonds hereby authorized, at their several dates of maturity, and any balance collected at any time from such special annual tax after the payment of principal and interest upon the bonds hereby authorized shall be deposited in the local improvement bond fund. SECTION 16 . That this resolution shall be effective immediately upon its passage and adoption as required by law. PASSED and ADOPTED this 21st day of April, A.
