Resolution 11515 RESOLUTION NO. 11515 WHEREAS, the City Council of the City of Miami Beach, Florida did adopt Resolution Number 11456 authorizing the entry by the City into an agreement with Consolidated Mutual Insurance Company whereby it could pay its full liability of $15,000 .00 to the plaintiff, Mary Nye, in a suit insti- tuted by her against the City involving alleged false arrest, false imprisonment, and assault and battery under protest, and without acknowledging its full liability on said policy of insurance, and WHEREAS, Lloyds of London is the insurance carrier in the said matter, and its liability, if it is so liable is in the sum of $1, 500 .00, and V WHEREAS, said Lloyds of London is willing to pay its said alleged liability in the sum of $1,500 .00 provided it is agreed that such payment shall and may be made with- out prejudice to its rights to assert its non-liability, and WHEREAS, the City Council of the City of Miami Beach has been advised by the City Attorney that the entry into ✓ such agreement is to the best interest of the City . THEREFORE, BE IT DULY RESOLVED THE CITY OF MIAMI BEACH, FLORIDA agrees that the payment by Lloyds of London for the sum of $1, 500 .00 to the plaintiff, Mary Nye, or to her attorneys for the sum of $1, 500 .00, in order to satisfy in full the judgment obtained by said plaintiff, shall be without prejudice in any way to Lloyds of London to assert its non-liability under the provisions with its insurance contract with the City of Miami Beach in relation to said suit.
