Resolution 11632 ------------- RESOLUTION NO. 11632 WHEREAS, the inevitable problems which confront a munici- pality as unique and beyond compare as the City of Miami Beach in the very nature of things possess a depth and breadth and are so fraught with complexity and consequence as to challenge the imagination and require the inspired efforts of all its dedicated citizenry to achieve solution, and WHEREAS, the City Council of the City of Miami Beach has found and determined that the creation and maintenance of ad- visory boards comprised in whole or in part of citizens of the community, invariably serving without compensation or remunera- tion but giving richly and without stint the full measure of their endowments of specialized skills, knowledge and exper- ience, all for the encouragement, enhancement and augmentation of the general welfare and economic benefit of the City and its residents, and WHEREAS the City of Miami Beach and its residents are the perpetual beneficiaries of the advice and guidance given by such advisory boards to the City Council of the City of Miami Beach, and WHEREAS it is the consensus of the City Council of the City of Miami Beach that the appointment to andmembership of any such dedicated citizen on more than one board created and constituted by the City Council of the City of Miami Beach, whether such appointment is made by the City Council , an individual member thereof or by the City Manager, requires an unwarranted and inequitable sacrifice and demanu upon the time, energies, efforts, industry and devotion of the dedica- ted citizenry herein referred to, and WHEREAS such duality of membership can of course create no conflict of interest, because of the character and unified objectives of the citizens comprising such boards, but WHEREAS there are numerous citizens in the City of Miami Beach equally endowed with the same specialized skills, and knowledge of experience hereinabove alluded to, and equally imbued with the generous, unselfish desire to serve their fellow citizens, but who presently possess no membership on any Advisory Board of the City of Miami Beach, NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, as follows: 1. That from hereon and henceforth no person shall be appointed to or serve upon more than one City Board created and constituted under authority of any Act of the Legislature, Ordinance eResolution of the City Council if so appointed or so serving shall designate in writing to the City Clerk not less than fifteen (15) days after the existence of duality of membership upon which Board he desires to serve or continue to serve, and the absence of such designation, shall be deemed a forfeiture of membership in each and every Board to which he has been appointed, - 1 - OFFICE OF CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 7 2. That the foregoing provision shall be applicable to all Boards of the City of Miami Beach without any exclusion of whatsoever nature, 3. Further providedthat none of the foregoing provisions shall be applicable to any Board wherein the Mayor, City Manager or other City officer is a member ex virtute officii, and 4. Be it further provided that any member of any City Board herein alluded to upon announcement that he is or upon qualification as a candidate for any elective public office, whether Federal, State, County or Municipal, shall be deemed to have forfeited his membership on such Board and a vacancy shall be deemed to automatically occur without any action by the City Council, and such vacancy shall be filled in the same manner as the pre-existing appointment was made.
