RESOLUTION NO. 11675
A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE ON BEHALF OF THE CITY OF
MIAMI BEACH AN INSTRUMENT RELATING TO THE
ABANDONMENT OF A PUBLIC ALLEY IN FORTY
FIRST STREET BLOCK.
WHEREAS, by the terms of that certain Plat of "Forty First
Street Block" recorded in Plat Book 40 at page 47 of the Public
Records of Dade County, Florida, there was dedicated to the per-
petual use of the public that certain alley shown on said Plat
and whereas the owners of the land abutting said alley have re-
quested the City of Miami Beach to vacate a portion thereof, pro-
vided that said owners dedicate to public use an additional alley
to serve the purpose now served by the alley to be vacated as
aforesaid, and
WHEREAS, the City Attorney has prepared an instrument by the
terms of which the City relinquishes and surrenders all rights
conferred upon or granted to the City and the public by virtue of
said Plat as to that portion of said existing alley lying Easterly
of the Westerly line of Lot 6 of said subdivision produced
Southerly;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Clerk be and
they are hereby authorized and directed to execute said instrument
in the name of and on behalf of said City.
BE IT FURTHER RESOLVED that said instrument be delivered to
said owners only if, as and when there shall be delivered to the
City the deed of dedication heretofore prepared by the City
Attorney with the terms of which deed of dedication the City
Council is familiar.
