Resolution 12273 RESOLUTION NO. 12273
WHEREAS, the City Council of the City of Miami Beach,
Florida heretofore authorized the execution of a Contract with
AUTOMATIC VENDING SERVICE COMPANY, INC. for a Concession known
as "The Automatic, Coin-operated, Cigarette Dispensing Machines
Concession at Certain Municipal Bathing Beaches, Recreational
Facilities and Public Buildings " in the City of Miami Beach,
Florida; and
WHEREAS, at the time of so authorizing the City Council
was of the belief that the Specifications called for a 35$
price for cigarettes, whereas in truth, unknown to the Council,
the Specifications called for a price of 40$ per pack of
cigarettes; and
WHEREAS, the City Council of the City of Miami Beach,
Florida deems that the discrepancy is a material one and requires
the recision of said Contract, and that bids be requested on
the basis of a price of 35$ per pack of cigarettes;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Resolution authoriz-
ing the execution of said Contract be and the same is hereby
rescinded and that the said Contract be and the same is hereby
annulled and set aside, and that the City Manager be and he is
hereby instructed to take appropriate action to re-advertise
said Concession with said Specifications calling for a sale
price of 35$ per pack of cigarettes.
