Resolution 11732 RESOLUTION NO. 11732 WHEREAS Fleetwood Hotel, Inc. intends to demolish the existing Fleetwood Hotel and construct a new building on the said site, and WHEREAS the City of Miami Beach has a ten (10' ) foot storm sewer easement on the Northerly 5 ' of Lot 9 and the Southerly 5 ' of Lot 10, Block 1, Amended Plat of Fleetwood Subdivision, according to the Plat thereof, recorded in Plat Book 28 at Page 34 of the Public Records of Dade County, Florida, by virtue of that certain instrument dated April 13, 1925 recorded in Deed Book 658 at Page 11 of the Public Records of Dade County, Florida, and pursuant to said easement City of Miami Beach has constructed and maintains a 36" concrete terra cotta storm sewer therein, and WHEREAS Fleetwood Hotel, Inc. has requested that said easement and said sewer be abandoned, and in consideration thereof said Fleetwood Hotel, Inc. will grant to the City a new easement over, upon and under the Southerly 10' of said Lot 9, and pay the costs of the construction of a new sewer, and WHEREAS it is estimated that the cost of construction of said new sewer will be approximately $26, 785.00, and WHEREAS Fleetwood Hotel, Inc. has offered to pay the said sum of $26, 785 .00 to the City to cover the cost of the con- struction of said new sewer with the further agreement that if the construction costs more than said amount Fleetwood Hotel, Inc. will pay the additional sum with the understanding that in the event the construction cost be less than $26, 785.00, the City will refund the difference to Fleetwood Hotel, Inc. , and WHEREAS the City Council of the City of Miami Beach, Florida deems it to be to the best interest of the City of Miami Beach and its citizens that the said proposal of Fleetwood Hotel, Inc. be accepted, and WHEREAS appropriate instruments have been prepared to authorize and to accomplish the foregoing, namely an instrument whereby the City of Miami Beach will relinquish and surrender all its right, title and interest to the said existing easement hereinabove described; and an appropriate instrument whereby Fleetwood Hotel, Inc. , a Florida corporation, grants to the City a new easement in lieu of the easement to be abandoned by the City; together with an agreement by Fleetwood Hotel, Inc. to pay the costs of construction of a new storm sewer in the new easement. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and the City Clerk be and they are hereby authorized and directed to execute - 1 OFFICE OF CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 7 the said instrument relinquishing and surrendering said exist- ing easement provided, however, that the said instruments shall not be delivered to Fleetwood Hotel, Inc. until there has been delivered to the City Clerk by Fleetwood Hotel, Inc. a duly executed grant of the new easement hereinabove described, said instrument to be satisfactory as to form to the City Attorney, and upon the certification by the City Clerk that said Fleetwood Hotel, Inc. has paid in full the costs of the construction of the new storm sewer in the new easement. PASSED and ADOPTED this 2nd day of February, 1966.
