Resolution 12329 RESOLUTION NO. 12329
WHEREAS, GEORGE ABBOTT, a single man, has offered
to sell to the City of Miami Beach, for the sum of $57, 750.00
cash (of which amount the sum of $1375.00 shall be payable
to the law firm of SHAPIRO, FRIED & WEIL, attorneys for the
owner, as attorneys ' fees) , that certain parcel of land
situate, lying and being in the City of Miami Beach, County
of Dade and State of Florida, described as follows, to wit:
Lot 3, in Block 2, of ALTOS DEL
MAR. NO. 2, according to the plat
thereof, recorded in Plat Book 4,
at page 162 of the public records
of Dade County, Florida;
the said owner to have the right to retain and remove special
lighting fixtures, air-conditioners and shrubbery now in and
on the premises hereinabove described; and
WHEREAS, the City Council of the City of Miami Beach
deems it to be in the best interest of said City to acquire
said property at said price, and upon the terms and conditions
set forth in said offer, for the purpose of an ocean front
public park, in connection with Open Space Land Project
NO. Fla. OSA-18; and
WHEREAS, the City Attorney has prepared an agreement
embodying the terms and conditions of said offer, with the
contents whereof the City Council is familiar;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the
City Clerk and Finance Director be and they are hereby
authorized and directed to execute said agreement in the
name of and on behalf of said City, and that the disbursing
officers of said City be and they are hereby authorized and
directed to disburse the monies required by the terms of said
agreement from funds of the City available for such purpose.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that SAUL Z. BENNETT, the City's
negotiator in connection with this transaction, be paid a
fee for his services as such negotiator upon consummation of
said proposed transaction in the sum of $1155.00, and that the
proper disbursing and financial officers of the City be and they
are hereby authorized and directed to disburse said sum as afore-
said from funds of the City available for such purpose.
