Resolution 12384 RESOLUTION NO. 12384 A RESOLUTION CALLING AND PROVIDING FOR A SPECIAL MUNICIPAL ELECTION TO BE HELD ON THE 28TH DAY OF MAY, 1968, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY OF MIAMI BEACH, FLORIDA, FOR THEIR APPROVAL OR DISAPPROVAL, AN ORDINANCE KNOWN AS ORDINANCE NO. 1688, PASSED AND ADOPTED BY THE CITY COUNCIL ON THE 6TH DAY OF MARCH, 1963, AND ENTITLED: "AN ORDINANCE GRANTING TO MALL TRANSPORT, INC. , A FLORIDA CORPORATION, AND TO ITS SUCCESSORS AND ASSIGNS, THE RIGHT TO USE THAT PORTION OF LINCOLN ROAD LYING WEST OF THE WESTERLY LINE OF WASHINGTON AVENUE TO THE EASTERLY LINE OF ALTON ROAD, OTHERWISE KNOWN AS THE LINCOLN ROAD MALL, AND ANY FUTURE EASTERLY AND/OR WESTERLY EXTENSION OF SAID MALL ON SAID LINCOLN ROAD, IN THE CITY OF MIAMI BEACH, AND ITS SUCCESSORS FOR AND DURING A PERIOD OF FIVE (5) YEARS, FOR THE PURPOSE OF ESTABLISHING, OPERATING AND MAINTAINING A VEHICULAR TRANSPORTATION SYSTEM FOR TRANSPORTING PASSENGERS FOR COMPENSATION, IN CONFORMITY WITH AND SUBJECT TO ALL PROVISIONS, TERMS AND CONDITIONS HEREIN RECITED. " WHEREAS the City Council of the City of Miami Beach, Florida, at a regular meeting duly called and held according to law, on the 6th day of March, 1968, passed, upon its third and final reading an ordinance known as Ordinance No. 1638, entitled: "AN ORDINANCE GRANTING TO MALL TRANSPORT, INC , A FLORIDA CORPORATION, AND TO ITS SUCCESSORS AND ASSIGNS, THE RIGHT TO USE THAT PORTION OF LINCOLN ROAD LYING WEST OF THE WESTERLY LINE OF WASHINGTON AVENUE TO THE EASTERLY LINE OF ALTON ROAD, OTHERWISE KNOWN AS THE LINCOLN ROAD MALL, AND ANY FUTURE EASTERLY AND/OR WESTERLY EXTENSION OF SAID MALL ON SAID LINCOLN ROAD, IN THE CITY OF MIAMI BEACH, AND ITS SUCCESSORS FOR AND DURING A PERIOD OF FIVE (5) YEARS, FOR THE PURPOSE OF ESTAB- LISHING, OPERATING AND MAINTAINING A VEHICULAR TRANSPORTATION SYSTEM FOR TRANSPORTING PASSENGERS FOR COMPENSATION, IN CONFORiMITY WITH AND SUBJECT TO ALL PROVISIONS, TERMS AND CONDITIONS HEREIN RECITED" and WHEREAS, under the provisions of Section 26 of the Charter of the City of Miami Beach, Florida, and as recited in Section 17 of said Ordinance No. 1688, said ordinance shall not become a law until the same has been approved by a majority of the qualified voters of the City of Miami Beach, Florida, voting thereon at an election held for such purpose, and WHEREAS the City Council has determined that said ordinance shall be in force after its approval by a majority of the qualified voters of the City of Miami Beach, Florida, voting at a special election held therefor, and upon the filing of acceptance thereof by said Company, the effective date of said ordinance, however, to be not less than forty (40) days after the final passage thereof by the City Council; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That a special municipal election is hereby called and directed to be held in the City of Miami Beach, Florida, from 7 :00 o'clock A.M. until 7 : 00 o'clock P.M. , Eastern Standard Time, on Tuesday, May 28, 1968, for the purpose of submitting to the quali- fied voters of the City of Miami Beach, Florida, for approval or disapproval, an ordinance known as Ordinance No. 1638, entitled as aforesaid, and passed and adopted by the City Council on third and final reading on the 6th day of March, 1968. SECTION 2. That said special municipal election shall be held at the following polling places in precincts designated, to wit: -1- PRECINCT NO. 58: That part of the City of Miami Beach bounded on the North and West by the limits of the City of Miami Beach; bounded on the South by the center line of Indian Creek; bounded on the East by a line described as follows: beginning at the intersection of the center line of Indian Creek and the center line of Tatum Waterway run Northerly along Tatum Waterway to the Southerly extension of the center line of Hawthorne Ave. , thence run Northerly along the center line of Hawthorne Ave. to the center line of 31 Street, Miami Beach; thence run Easterly along the center line of 31 Street to the center line of Tatum Waterway; thence run Northerly to the boundary of the City of Miami Beach; the Polling Place of which shall be at the Biscayne Elementary School , situated at 800 - 77th Street. PRECINCT NO. 59: Bounded on the North by the center line of 77th Street; bounded on the South by the center line of 71st Street; bounded on the East by the Easterly boundary of the State of Florida; bounded on the !Jest by the center line of Indian Creek and the center line of Tatum Waterway; the Polling Place of which shall be at the North Shore Park Teen Center, situated at the corner of Byron Avenue and 72nd Street. PRECINCT NO. 60: All that part of Miami Beach known as Normandy Isle and its surrounding waters which lie Southerly of the line described as follows: beginning at the East end of the 79th Street Causeway bridge run Easterly along the center line of Normandy Drive to the center line of Verdun; thence run Northwesterly along Verdun to the center line of Marseille Drive; thence run Easterly along Marseille Drive to the center line of Rue Notre Dame; thence run Southeasterly to the center line of Normandy Drive; thence run Easterly to Indian Creek; the Polling Place of which shall be at the Normandy Isle Municipal Pool , situated at 7030 Trouville Esplanade. PRECINCT NO. 80: Bounded on the North by the center line of LaGorce Canal from Biscayne Bay to the West line of Indian Creek and the center line of 63rd Street from the East Shore of Allison Island to the Atlantic Ocean; bounded on the South by the center line of 51st Street and its Westerly and Easterly exten- sions; bounded on the East by the East boundary of the State of Florida; bounded on the West by the City Limits of Miami ; the Polling Place of which shall be at the 69th Street Fire Station, situated at 6860 Indian Creek Drive. PRECINCT NO. 81 : Bounded on the North by the center line of 44th Street and its Easterly and Westerly extensions; bounded on the South by the center line of 34th Street and its Easterly and Westerly extensions; bounded on the East by the East boundary of the State of Florida; bounded on the West by the center line of Biscayne Waterway; the Polling Place of which shall be at the North Beach Elementary School , situated at 711 Arthur Godfrey Road. PRECINCT NO. 289: Bounded on the North by the center line of 15th Street and its Easterly extension; bounded on the South by the center line of 13th Street; bounded on the East by the East boundary of the State of Florida; bounded on the blest by the center line of Meridian Avenue; the Polling Place of which shall be at the Ida M. Fisher Junior High School Gymnasium, Corner of 14th Place and Pennsylvania Avenue. PRECINCT NO. 290: Bounded on the North by the center line of 11th Street; bounded on the South by the center line of 7th Street; bounded on the East by the center line of Euclid Avenue; bounded on the West by the center line of Michigan Avenue; the Polling Place of which shall be at the new Fire Station , situated at 1051 Jefferson Avenue. • PRECINCT NO. 291 Bounded on the North by the center line of 7th Street; bounded on the South by the center line of 3rd Street; bounded on the East by the East boundary of the State of Florida; bounded on the ,lest by the center line of Meridian Avenue; the Polling Place of which shall be at the Ocean Front Auditorium, situated at 10th Street and Ocean Drive. -5- SECTION 3. That, for the purpose of enabling persons to register who are qualified to register for, and to vote in said special municipal election, the City Clerk, who is also Supervisor of Registration, shall open the books of said City from 9:00 o' clock A. I. until 5 :00 o' clock P.M. on each day, Sundays and Holidays excepted, from March 21, 1968, to April 27, 1968, both inclusive, and after said April 27, 1968, no person shall be registered for said election. SECTION 4. That the official ballot to be used at said special municipal election shall be in full compliance with the laws of the State of Florida with respect to absentee ballots and to the use of mechanical voting machines, and shall be substantially in the following form, to wit: "OFFICIAL BALLOT SPECIAL MUNICIPAL ELECTION MAY 28, 1968 FOR APPROVAL OR DISAPPROVAL OF THE FOLLOWING QUESTION: Shall the ordinance known as Ordinance No. 1688, passed and adopted on its third and final reading on the 6th day of March, 1968, and entitled: "AN ORDINANCE GRANTING TO MALL TRANSPORT, INC. , A FLORIDA CORPORATION, AND TO ITS SUCCESSORS AND ASSIGNS, THE RIGHT TO USE THAT PORTION OF LINCOLN ROAD LYING WEST OF THE WESTERLY LINE OF WASHINGTON AVENUE TO THE EASTERLY LINE OF ALTON ROAD, OTHERWISE KNOWN AS THE LINCOLN ROAD MALL, AND ANY FUTURE EASTERLY AND/OR WESTERLY EXTENSION OF SAID MALL ON SAID LINCOLN ROAD, IN THE CITY OF MIAMI BEACH, AND ITS SUCCESSORS FOR AND DURING A PERIOD OF FIVE (5) YEARS, FOR THE PURPOSE OF ESTABLISHING, OPERATING AND MAINTAINING A VEHICULAR TRANSPORTATION SYSTEM FOR TRANSPORTING PASSENGERS FOR COMPENSATION, IN CONFORMITY WITH AND SUBJECT TO ALL PROVISIONS, TERMS AND CONDITIONS HEREIN RECITED" be approved or disapproved? MAKE A CROSS (X) BEFORE YOUR CHOICE FOR THE ORDINANCE AGAINST THE ORDINANCE" -6- Provided, however, that if the voting machines provided by Dade County cannot, because of lack of space, accommodate the ballot hereinabove set forth, the City Clerk is authorized to use paper ballots in conjunction with said voting machines in the manner authorized by Section 101.27, Florida Statutes. In casting an absentee ballot, mark an "X" in the square before the words 'FOR THE ORDINANCE" to indicate your approval of Ordinance No, 1688; mark an "X" in the square before the words "AGAINST THE ORDINANCE" to indicate your disapproval of Ordinance No. 1688. In the use of the mechanical voting machine, turn down the voting machine lever above the words "FOR THE ORDINANCE" to indicate your approval of Ordinance No. 1688; turn down the voting machine lever above the words "AGAINST THE ORDINANCE" to indicate your disapproval of Ordinance No. 1633. SECTION 5. For the purpose of enabling persons to register who are qualified to register for and to vote in said special municipal election the registration books of the City of Miami Beach will be open in the City registration office in the office of the City Clerk, in the City Hall, from 9:00 o' clock A.M. until 5:00 o' clock P.M. , on each day, Sundays and Holidays excepted, from March 21, 1968, to April 27, 1968, both inclusive, and after April 27, 1968, no person shall be registered for said election. Only persons properly registered will be qualified to vote in said election. By order of the City Council of the City of Miami Beach, Florida.
