RESOLUTION NO. 11763
WHEREAS by that certain instrument recorded in Official
Record Book 4895, Page 544 of the Public Records of Dade County,
Florida the City of Miami Beach, Florida was heretofore granted a
perpetual easement for underground utilities in and under that
certain land described in said instrument, and
WHEREAS there is located in said easement a 12 inch water
main belonging to said City, and also a certain telephone conduit
belonging to Southern Bell Telephone Company, and
WHEREAS the owner of the fee simple title of said land has
requested the City to abandon, surrender and relinquish said
easement, except the westerly portion thereof bounded by a line
parallel to and 10 feet East of the aforesaid Westerly boundary
of said land as more fully described in the map prepared by the
City Engineer and attached hereto, and in consideration of said
abandonment will reimburse the City for the cost of relocating
said water main westerly within the said westerly 10 feet of said
easement, the estimated cost of the moving thereof being $24, 000.00,
and
WHEREAS the City Council of the City of Miami Beach, Florida
finds that there is no need presently or in the foreseeable
future for that portion of said easement, the abandonment of
which has been requested, and that it is to the best interests of
the City and its citizens that said request be granted, and
WHEREAS an appropriate instrument has been prepared to auth-
orize and to accomplish the relinquishment, surrender and aban-
donment of the described portion of said easement, the abandonment
of which has been requested,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA that all of that certain ease-
ment described in that certain instrument recorded in Official
Records Book 4895, Page 544 of the Public Records of Dade County,
Florida with the exception of that portion of said easement
bounded on the East by a line parallel to and 10 feet East of the
Westerly boundary of said easement as more fully shown and
described by the said map attached hereto and made a part hereof,
be and the same is hereby surrendered, relinquished and abandoned.
BE IT FURTHER RESOLVED by the City Council of the City of
Miami Beach, Florida that the Mayor and the City Clerk be and
they are hereby authorized and directed to execute said instru-
ment relinquishing, surrendering and abandoning that portion of
said easement herein described and as shown on said map attached
hereto provided, however, that the said instrument shall not be
delivered until the City Clerk has certified that said owner in
fee has paid in full the cost of the removal and relocation of
said 12 inch water main and upon the further certification by the
City Engineer that the existing telephone conduit has been removed
and relocated to the satisfaction of Southern Bell Telephone
Company.
