Resolution 12420 RESOLUTION NO. 12420
WHEREAS the owner of the fee simple title in and to
Lots 2 and 11, Block 14, NORMANDY BEACH SOUTH, Plat Book 21, at
page 54 of the Public Records of Dade County, Florida, has requested
the City of Miami Beach to surrender and relinquish all its
right, title and interest in and to the northerly five feet of
an existing ten-foot easement on the south side of said Lots 2
and 11, and
WHEREAS the said owner has represented to the City
of Miami Beach that it will pay the cost of moving and relocating
an existing City water main from the center of said existing
ten-foot easement to the south five (5) feet thereof, and further
that it will procure appropriate waivers and releases from all
public utility companies having any right, title or interest in
and to said easement, and
WHEREAS the City Council of the City of Miami Beach
has found and determined that it is in the best interest of the
City to surrender and relinquish its right, title and interest
to said northerly five feet of said easement as requested,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the City of
Miami Beach for itself, its successors and assigns, does hereby
surrender and release to said owner of Lots 2 and 11, and its
successors and assigns, all its right, title and interest to the
northerly five feet of said easement, provided, however, that
this release, surrender and relinquishment shall not be effective
until and on condition that said owner pay the cost of relocating
said City water main as hereinabove set forth, and upon the
further condition that said owner procure and deliver to the
City Clerk of the City of Miami Beach appropriate and satisfactory
waivers and rel`ases executed and delivered by all public utility
companies having any interest therein in and to said northerly
five feet of said ten-foot easement, waiving and surrendering all
their right, title and interest in and to said northerly five
feet of said ten-foot easement.
PASSED AND ADOPTED this 1st day of May , 1968.

Subject: Lots 2 and 11, Block 14
Normandy Beach South
South side of 71 Street between
Byron and Carlyle Avenues
This relates to the petition to the City of Miami Beach by the owners
of subject property to effect release of a portion of a 10' easement
along the south 10' of Lots 2 and 11.
We understand that the proposed development on this property will
include a building 36' 9" in height encroaching onto the northerly 5'
of the existing 10' easement now enjoyed jointly by the City and the
Company.
The Company waives objections to this proposed development, provided
that buildings, structures, columns, signs, etc. , within the north 5'
of the south 10' of Lots 2 and 11 be restricted in height not to exceed
36' 9" above existing grade.
The Florida Power & Light Company does hereby release and cancel
its use to the easements across the following described land, providing
the height restrictions stated herein are observed, to wit:
North five feet (5') of south ten feet (10') of Lots 2 and 11,
Block 14, Normandy Beach South (21-54).

RELEASE OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS that SOUTHERN BELL TELEPHONE AND TELEGRAPH COMPANY,
a New York corporation, for and in consideration of One ($1.00) Dollar, receipt whereof is hereby acknowledged, has
rebased and surrendered, and by these presents does release and surrender its right to an easement on the following
described property, situate, lying and being in D$de County, Florida:
The north five (5) feet of an existing ten( 1O) foot
easement of right-of-way lying along the north side
of the south lot lines of lots two (2) and eleven
( 11) , Block fourteen (14) , Normandy Beach South, as
