Resolution 12490 RESOLUTION NO. 12490
WHEREAS the City of Miami Beach has instituted
condemnation proceedings against various parcels of land for
public park purposes , and
WHEREAS William G. Friedemann and Elizabeth M.
Friedemann, his wife, are the owners of one parcel of land
designated as Parcel No. 26 in said condemnation suit , filed
in Circuit Court of the Eleventh Judicial Circuit in and for
Dade County, bearing Case No. 68-1265 , said parcel of land
being legally described as follows , to wit:
Lot 3 , Block 8 , ALTOS DEL MAR NO. 2 ,
according to the Plat thereof , recorded
in Plat Book 4 at page 162 of the
Public Records of Dade County, Florida;
and
WHEREAS the said William G. Friedemann and
Elizabeth M. Friedemann, his wife, by and through their
attorneys , Mershon, Sawyer , Johnston, Dunwoody and Cole,
have offered to sell said parcel of land to the City for the
sum of $36 ,750. 00 , including attorneys' fees and court expenses
and costs , if any, with taxes to be prorated as of 1968 , and
WHEREAS the City Council of the City of Miami Beach
deems it to be in the best interest of said City to acquire
said property at said price , and upon the terms and conditions
set forth in said offer , documentary stamps to be paid for by
the sellers , and
WHEREAS Saul Z. Bennett , the negotiator for the City,
is entitled to his fee of 2% of said $36 ,750. 00 for his services
in negotiating said purchase ,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Attorney be
and he is hereby authorized to consent and to stipulate to the
entry of a final judgment in said condemnation suit vesting
title to said parcel of land in the City of Miami Beach upon the
payment of the said compensation to the said owners of said land,
and that the proper disbursing and financial officers of the
City be and they are hereby authorized and directed to disburse
said sum as afrresaid for the consummation of the transaction
hereinabove described.
