Resolution 11816 RESOLUTION NO. 11816
WHEREAS Norman Tainsley was employed by the City of Miami
Beach as a policeman and detective for a period of more than
twenty years, and
WHEREAS at the time of his retirement the amount of accu-
mulated leave to which the said Norman Tainsley was entitled
was in dispute, the amount involved being approximately $2, 500,
because the said Norman Tainsley contended that certain charges
against the same were improper as his absence was due to a ser-
vice connected injury; the City, however, contended to the
contrary, and
WHEREAS the said Norman Tainsley thereafter instituted
suit against the City in the Civil Court of Record in and for
Dade County, Florida, the same being Case No. 63-5551, and
WHEREAS the City Attorney has advised the City Council
that the defense of said suit will entail the expenditure of
substantial amounts for expert medical testimony, and
WHEREAS the City Attorney has recommended that it is in
the best interests of the City that the said suit be settled
and compromised for the sum of $1, 500.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA that the said recommendation
of the City Attorney be and the same is hereby accepted, and
the City Attorney is hereby authorized and directed to draw the
necessary papers to obtain a dismissal of the said cause with
prejudice to the said Norman Tainsley and to prepare and obtain
from the said Norman Tainsley a full and complete Release and
Discharge from any and all rights, claims, suits and demands
of whatsoever nature, past, present and future, arising in and
out of the claim of said Norman Tainsley that the injury being
the subject matter of the said suit is or was attributable or
connected with his service to the City.
BE IT FURTHER RESOLVED that the financial officers of the
City be and they are hereby authorized and directed to pay the
said sum of $1, 500 to the said Norman Tainsley upon being ad-
vised that said suit has been dismissed and that the Release
and Discharge has been duly executed and delivered by the said
Norman Tainsley.
