Resolution 11834 RESOLUTION NO. 11834 WHEREAS, Jimmie Pearson, while employed in the Engineering Department of the City of Miami Beach, suffered a Workmen's Compensation injury on September 22, 1964, for which injury medical treatment was furnished and Workmen's Compensation dis- ability payments were made, and WHEREAS, the said Jimmie Pearson has heretofore filed a claim for additional Workmen's Compensation disability payments and for further medical treatment, and a controversy exists as to the need for additional medical treatment and as to the en- titlement for any additional earning capacity disability compensation payment, and WHEREAS, the attorney for the said Jimmie Pearson has offered to settle the controversy and end all litigation on a lump sum washout basis of $210.00 for the said Jimmie Pearson, $100.00 for the attorney and $60.00 for the examining fee of the doctor selected by the said Jimmie Pearson, and WHEREAS, the City Attorney has recommended the acceptance of such offer, and WHEREAS, it is deemed in the best interest of the City of Miami Beach, as well as the former employee, to enter into such agreement, NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA that the said settlement offer calling for the payment to the said Jimmie Pearson of $210.00, $100.00 to the attorney for the said Jimmie Pearson, and $60.00 to the doctor selected by the said Jimmie Pearson as an examin- ing fee, be and the same is hereby accepted, and the proper financial officers of the City be and they are hereby authorized and directed to make the payments called for by said offer of settlement.
