Resolution 12548 RESOLUTION NO. 12548
WHEREAS, on June 25, 1967 one Klaus J. Karwath, while
employed by the City of Miami Beach was injured when he attempted
to move a lifeboat into the water, and
WHEREAS, said employee ' s condition was diagnosed as a
herniated intervertebral disc producing severe low back pain and
right leg immobility, and
WHEREAS, said employee was examined and extensively
treated by Doctors Mario Stone and Alvin Tobis, who evaluated the
patient, respectively, as having 10% and 15% permanent partial
disability of the body as a whole, and
WHEREAS, Mr. Karwath underwent an operation on July 26,
1967 for removal of a disc in the lumbar-sacral area of his back,
and
WHEREAS, claimant ' s physician Dr. Theodore Struhl has
evaluated Mr. Karwath ' s disability at 20-25% of the body as a
whole, and
WHEREAS, a final hearing was held before Judge Alfred
Kreisler on August 26, 1968 at the conclusion of which Judge
Kreisler suggested that the City settle this case if at all
possible, and
WHEREAS, a joint petition was entered into and approved
by the Florida Industrial Commission therein providing that the
City of Miami Beach pay the injured a lump sum of $735.00; pay
his attorney $400. 00 as a reasonable attorney ' s fee; and pay
Dr. Struhl ' s bill in the amount of $22. 50, making a total of
$1157 . 50, and
WHEREAS, payment of the sums hereinbefore set forth will
discharge all liability under Florida Statutes, Chapter 440 for
compensation benefits and further that the Order of the Florida
Industrial Commission with respect to liability for compensation
benefits will not be subject to modification or review, and
WHEREAS, the City Council deems it to be in the best
interest of the City to enter into settlement of this case on
the terms set out above,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, that the Mayor and City Clerk and Finance
Director and Insurance Manager be and they are hereby authorized
to comply with the forthcoming Order of the Florida Industrial
Commission regarding settlement of Mr. Karwath ' s claim.
