Resolution 11859 RESOLUTION NO. 11859 WHEREAS the City Council of the City of Miami Beach, Florida is considering amending ordinance No. 289, commonly known as the "Zoning Ordinance of the City of Miami Beach, Florida" and the maps attached thereto and made a part thereof, so as to add a new section thereto, to be numbered and to read as follows : "SECTION 16-D GENERAL PROVISIONS APPLICABLE TO APARTMENTS AND APARTMENT HOTELS ONLY A: HEIGHT Any provisions or restrictions pertaining to limitations and restrictions set forth in this ordinance as to the height of buildings shall not apply to apartments or apartment hotels as herein defined. B: LOT COVERAGE The term "Lot Coverage" as herein used shall mean the percentage of total area of the lot that, when viewed directly from above, would be covered by all principal and accessory buildings and structures, or portions thereof, that are included in the calculation of floor area of a building. The lot coverage permitted for apartments and apart- ment hotels shall not exceed the following: HEIGHT OF BUILDING PERCENT OF LOT AREA 20 feet or less 30% 20.1 feet to 30 feet 28% 30. 1 feet to 40 feet 26% 40.1 feet to 50 feet 24% 50.1 feet to 60 feet 23% 60.1 feet to 70 feet 22% 70. 1 feet to 80 feet 21% 80.1 feet to 90 feet 20% 90.1 feet to 100 feet 19% 100.1 feet to 110 feet 18% 110.1 feet to 120 feet 17% 120.1 feet to 130 feet 16% 130. 1 feet or more 15% C: FLOOR AREA RATIO The permitted floor area ratio, for apartments and apartment hotels, shall be the ratio between the total floor area of a building and the total area of the lot occupied by the building. The floor area ratio shall not exceed 2 .00. D: YARDS (1) FRONT YARD - Every lot shall have a front yard not less than twenty (20) - 1 - OFFICE OF CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 feet in depth. No parking shall be permitted in the required front yard. (2) SIDE YARD - Every lot shall have a side yard of at least ten percent (10%) of the width of the lot, provided that no side yard shall be less than 7.5 feet. (3) REAR YARD - Every lot shall have a rear yard of not less than twenty (20) feet in depth plus an additional one (1) foot for each two (2) feet of building height above twenty- five (25) feet. The requirements imposed by this paragraph are minimal requirements. If any provision or regulation con- tained in this ordinance imposes a higher requirement, then and in such event, such higher requirement or provision shall prevail. E: PARKING The ratio of parking spaces to dwelling units in apartments and apartment hotels shall be three (3) parking spaces for every two units. Each parking space shall be not less than two hundred (200) square feet. This provision shall not be deemed to eliminate any other applicable requirement for parking spaces contained in this ordinance. F: DENSITY STANDARDS: Density districts for apart- ments and apartment hotels are hereby created as follows: MULTI-FAMILY DENSITY RESIDENTIAL DISTRICT RANGE Medium Density 12.1 - 50 Units Per Acre High Density 50.1 - 100 Units Per Acre A unit is defined as any room or group of rooms located within a dwelling and forming a single habitable unit with facilities used or intended to be used for living, sleeping, cooking and eating. The MULTI-FAMILY MEDIUM DENSITY DISTRICT shall include all parcels of land in those areas of the City described as follows: Those areas bounded by a line drawn as follows: 1. Beginning at the intersection of the north right- of-way line of Biscayne Street and the east right- of-way line of Jefferson Avenue, proceed northerly along the east right-of-way line of Jefferson Ave- nue to its intersection with the easterly right- of-way line of Alton Road extended; then - 2 - OFFICE OF CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 northwesterly along the easterly right-of-way line of Alton Road to the south right-of-way line of Fifth Street; then east along the south right-of- way line of Fifth Street to the westerly right-of- way line of Ocean Drive; then southerly along the westerly right-of-way line of Ocean Drive to the north right-of-way line of Biscayne Street; then west along the north right-of-way line of Biscayne Street to the Point of Beginning. 2. Beginning at the north right-of-way line of Fifth Street and the centerline of Michigan Avenue, pro- ceed northerly along the centerline of Michigan Avenue to the centerline of 7th Street; then west- erly along the centerline of 7th Street to the east right-of-way line of Alton Road; then north along the east right-of-way line of Alton Road to the north right-of-way line of 14th Court extended; then east along said right-of-way line extended to the centerline of Lenox Avenue; then northerly along the centerline of Lenox Avenue to the south right-of-way line of 16th Street; then east along the south right-of-way line of 16th Street to the west right-of-way line of Washington Avenue; then southerly along the west right-of-way line of Washington Avenue to the north right-of-way line of Fifth Street; then west along the north right- of-way line of Fifth Street to the Point of Beginning. 3. Beginning at the intersection of the north right- of-way line of 17th Street and the centerline of Lenox Avenue, proceed northerly along the center- line, and the centerline extended, of Lenox Avenue to the southerly bulkhead line of Collins Canal; then easterly along the southerly bulkhead line of Collins Canal to the centerline of Meridian Avenue; then south along the centerline of Meridian Avenue to the north right-of-way line of 17th Street; then east along the north right-of-way line of 17th Street to the Point of Beginning. 4. Beginning at the intersection of the northerly bulkhead line of Collins Canal and the easterly right-of-way line of Pine Tree Drive, proceed northerly along the easterly right-of-way line of Pine Tree Drive to the southerly intersection of Pine Tree Drive and Flamingo Drive; then northeast- erly along the centerline of Flamingo Drive to the southerly line of the public right-of-way line running between Flamingo Drive and Indian Creek and located north of 28th Street; then easterly along said public right-of-way line to the westerly bulkhead line of Indian Creek; then southerly along the bulkhead line of Indian Creek to its intersec- tion with the northerly bulkhead line of Collins Canal; then westerly along the northerly bulkhead line of Collins Canal to the Point of Beginning. - 3 - OFFICE OF CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 5 . Beginning at the intersection of the northerly bulkhead line of Biscayne Waterway and the easterly right-of-way line of Alton Road, proceed northerly along the easterly right-of-way line of Alton Road to the centerline of West 39th Street; then easter- ly along the centerline of West 39th Street to the centerline of Garden Avenue; then northerly along the centerline of Garden Avenue to the centerline of West 40th Street; then easterly along the center- line of West 40th Street to the centerline of North Meridian Avenue; then northerly along the centerline of North Meridian Avenue to the south right-of-way line of Arthur Godfrey Road; then easterly along the south right-of-way line of Arthur Godfrey Road to the westerly bulkhead line of Biscayne Waterway; then southerly and westerly along said bulkhead line of Biscayne Waterway to the Point of Beginning. 6. Beginning at the intersection of the centerline of North Bay Road and the northerly right-of-way line of Arthur Godfrey Road, proceed northwesterly along the centerline of North Bay Road to the intersec- tion with a line, which line is the southerly right- of-way line extended of West 43rd Street; then east- erly along said southerly right of way line to the centerline of North Michigan Avenue; then southerly along the centerline of North Michigan Avenue to the northerly right-of-way line of Arthur Godfrey Road; then westerly along the northerly right-of- way line of Arthur Godfrey Road to the Point of Beginning. 7 . All of that certain Island known as Park View Island. 8. Beginning at the intersection of the easterly bulk- head line of the first canal east of and parallel to Noremac Avenue and the northerly bulkhead line of Tatum Waterway, proceed northerly along the east bulkhead line of that canal east of and parallel to Noremac Avenue to the centerline extended of 83rd Street; then easterly along the centerline extended of 83rd Street to the centerline of Hawthorne Avenue; then northerly along the centerline of Hawthorne Avenue to the centerline of 86th Street; then east- erly along the centerline of 86th Street to the cen- terline of Crespi Boulevard; then southerly along the centerline of Crespi Boulevard to the centerline of 85th Street; then easterly along the centerline of 85th Street to the easterly bulkhead line of Tatum Waterway; then northerly along said bulkhead line to the north City Limit Line; then easterly along the City Limit Line to the centerline of Harding Avenue; then southerly along the centerline of Harding Avenue to the centerline of 73rd Street; then westerly along the centerline of 73rd Street - 4 - OFFICE OF CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 to the centerline of Dickens Avenue; then northerly along the centerline of Dickens Avenue to the cen- terline of 77th Street; then westerly along the cen- terline of 77th Street to the centerline of Tatum Waterway Drive; then southerly along the centerline, and the centerline extended of Tatum Waterway Drive to the north bulkhead line of the first waterway south of and parallel to 77th Street; then easterly along said bulkhead line and said bulkhead line extended to the northwesterly bulkhead line of Tatum Waterway; then southwesterly along said bulkhead line of Tatum Waterway to the Point of Beginning. 9. Beginning at the intersection on the Isle of Nor- mandy of the northerly right-of-way line of the North Bay Causeway and the bulkhead line of Bis- cayne Bay, proceed northerly along the bulkhead line of Biscayne Bay to the southerly bulkhead line of Normandy Waterway; then easterly along the south- erly bulkhead line of Normandy Waterway to the cen- terline extended of Ray Street; then northerly along the centerline of Ray Street to the southerly property line of the municipal golf course known as Normandy Shores Golf Course; then easterly along said property line to its intersection with the north right-of-way line of South Shore Drive; then continuing easterly along the north right-of-way line of South Shore Drive to the centerline of North Shore Drive; then northerly along the center- line of North Shore Drive to a point which is 303' along the centerline of North Shore Drive and from the northerly bulkhead line of Normandy Waterway; then easterly from said point along a line perpen- dicular to the centerline of North Shore Drive to the westerly bulkhead line of Indian Creek; then southerly along the westerly bulkhead line of Indian Creek to the northerly right-of-way line of 71st Street; then westerly along the north right-of-way line of 71st Street to the centerline of Bay Drive; then northerly along the centerline of Bay Drive to the north line of the first alley north of and parallel to Normandy Drive; then westerly along said alley line, and said alley line extended to the centerline of Rue Notre Dame; then southerly along the centerline of Rue Notre Dame to the north- erly right-of-way line of 71st Street; then wester- ly along the north right-of-way line of 71st Street to the centerline of the first alley west of and parallel to Rue Granville; then north along the centerline of said alley to the centerline of Nor- mandy Drive; then westerly along the centerline of 0 Normandy Drive to the centerline of Verdun Drive; then northerly along the centerline of Verdun Drive to the centerline extended of MarseillesDrive; then westerly along the centerline of Marseilles Drive extended and parallel to Normandy Drive to the cen- terline of Bay Drive; then southerly along the - 5 - OFFICE OF CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 centerline of Bay Drive to the northerly right•-of- way line of North Bay Causeway extended; then westerly along said right-of-way line to the Point of Beginning. Also, all other areas presently zoned to permit multi- family residential dwellings to be constructed shall be classified as Medium Density. The MULTI-FAMILY HIGH DENSITY DISTRICT shall include all parcels of land in those areas of the City described as follows: Those areas bounded by a line drawn as follows: 1. Beginning at the intersection of the north right- of-way line of Fifth Street and the bulkhead line, as it may exist from time to time, of Biscayne Bay proceed northerly along said bulkhead line to a line which is the south right-of-way line of 17th Street extended; then easterly along said right- of-way line of 17th Street to the west right-of- way line of Alton Court; then south along the west right-of-way line of Alton Court to the north right-of-way line of 14th Court; then east along the north right-of-way line of 14th Court to the west right-of-way line of Alton Road; then south along the west right-of-way line of Alton Road to the north right-of-way line of Fifth Street; then west along the north right-of-way line of Fifth Street to the Point of Beginning. 2. Beginning at the north right-of-way line of 17th Street at a point 150' east of the east right-of- way line of Washington Avenue, proceed in a north- erly direction along a line 150' east of and par- allel to the east line of Washington Avenue to the centerline of 19th Street; then east along the centerline of 19th Street to a point 200' east of the east right-of-way line of James Avenue; then south along a line 200' east of and parallel to the east right-of-way line of games Avenue to the centerline of 18th Street; then west along the centerline of 18th Street for a distance of 50' ; then south along a line 150' east of and parallel to the east right-of-way line of James Avenue to the north right-of-way line of 17th Street; then west along the north right-of-way line of 17th Street to the Point of Beginning. 3. Beginning at the intersection of the north right- of-way line of 63rd Street and the easterly bulk- head line of Indian Creek, proceed northerly along said bulkhead line to the southerly bulkhead line of the first waterway north of and parallel to 71st Street; then east and north along the bulkhead line of said waterway to its intersection with the centerline of 72nd Street extended; then east along the centerline of 72nd Street to the center- line of Byron Avenue; then south along the center- line of Byron Avenue to the centerline of 69th Street; then east along the centerline of 69th Street to the centerline of Harding Avenue; then south along the centerline of Harding Avenue to the centerline of Indian Creek Drive; then south along the centerline of Indian Creek Drive to the north right-of-way line of 63rd Street; then west along the north right-of-way line of 63rd Street to the Point of Beginning. 5. Beginning at the intersection of the centerline of 73rd Street and Harding Avenue, proceed north- erly along the centerline of Harding Avenue to the centerline of 79th Street; then east along the centerline of 79th Street to the west right- of-way line of Collins Avenue; then south along the west right-of-way line of Collins Avenue to the centerline of 73rd Street; then west along the centerline of 73rd Street to the Point of Beginning. 6. Beginning at the intersection of the bulkhead line of Biscayne Bay and the centerline of Rue Notre Dame, proceed northerly along the center- line of Rue Notre Dame to a point 125 ' north of the north right-of-way line of Biarritz Drive; then easterly along a line 125 ' north of and par- allel to the north right-of-way line of Biarritz Drive to the east right-of-way line of Rue Versailles; then north along said right-of-way line to the south line of the first alley south of and parallel to 71st Street; then easterly along the south line of said alley to the center- line of Bay Drive; then northerly along the cen- terline of Bay Drive to the south right-of-way line of 71st Street; then easterly along the south right-of-way line of 71st Street to the westerly bulkhead line of Indian Creek; then southerly along said bulkhead line to its inter- section with the bulkhead line of Biscayne Bay; then westerly along the bulkhead line of Biscayne Bay to the Point of Beginning. - 7 - OFFICE OF CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 7 . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA that a public hearing be and the same is hereby called to be held on the 8th day of July, 1966, at 10:00 o'clock A.M. in the Council Chambers, City Hall, 1130 Washington Avenue, Miami Beach, Florida for the consideration of said amendment. BE IT FURTHER RESOLVED that the City Clerk be and he is hereby directed to give fifteen (15) days' notice of the time, place and object of said hearing by public notice thereof, published in the Miami Beach Daily Sun, a newspaper of general circulation in said City.
