Resolution 12585 RESOLUTION NO. 12585 WHEREAS, on May 10, 1967, one Geza Domokos, while employed for the City of Miami Beach was injured when his right foot became caught under the rear wheels of a fork lift, and WHEREAS, the injured employee was examined and treated by the City Physician, Dr. Leo Grossman, by Dr. M. P. Travers, by Dr. Alvin Tobis, by Dr. Edward Roth, by Dr. A. Kusher, by Dr. Lyle Russell, and by Dr. Bernard Tarr, and WHEREAS, on January 17, 1968 the said employee experiencedpain in the small of his back while he was pushing up a steel rail for raised seating, and WHEREAS, the said employee was examined and treated by Dr. Leo Grossman, by Dr. A. Kusher, by Dr. Lyle Russell, and by Dr. Bernard Tarr, and WHEREAS, the injured employee was given a rating by Dr. Lyle Russell of five (5) percent permanent partial disability of the right foot, and WHEREAS, the City voluntarily paid benefits based upon Dr. Lyle Russell ' s report of five (5) percent permanent partial disability of the right foot, and WHEREAS Dr. Bernard Tarr evaluated the patient as having ten (10) percent permanent partial disability of the right foot, and WHEREAS, the Legal Department has negotiated a tentative settlement with the claimant and his attorney on the following terms : 1. $550.00 to be paid by the City of Miami Beach to the claimant representing all past, present and future compensation and medical benefits due him. 2 . $200.00 to be ?aid to the claimant ' s attorney as a reasonable attorney' s fee, and WHEREAS, the payment of the sums hereinbefore set forth will discharge forever the City' s liability of every description for past, present and future Workmen' s Compensation Benefits payable as a result of the accidents under Chapter 440 Florida Statutes, and WHEREAS, the Order of the Judge of Industrial Claims approving the settlement stipulation will not be subject to modification or review, and WHEREAS, the City Council deems it to be in the best interests of the City to enter into a final settlement stipulation upon the terms hereinbefore set forth; NOW, THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF MIAMI BEACH that the Legal Department be authorized to enter into final settlement stipulation with Geza Domokos and his attorney, and if said agreement is approved by the Judge of Industrial Claims, the Mayor, the City Clerk and Finance Director, and the Legal Department be and they are hereby authorized and directed to comply with the Order of the Judge approving said stipulation.
