Resolution 12596 RESOLUTION NO. 12596
WHEREAS, on June 24, 1967 one Edward Bason, while
employed as a Police Officer by the City of Miami Beach, was
involved in an automobile accident and injured his lumbar
and dorsal back, and
WHEREAS, said employee was examined and treated by
the City Physician, Dr. Leo Grossman, received emergency
treatment at Mt. Sinai Hospital, was subsequently treated by
Dr. Joel Harris and Dr. Mario Stone, and was examined by Dr.
J. W. Barrett and Dr. Lyle Russell, and
WHEREAS, the treating physician, Dr. Stone, released
said employee with a permanent partial disability of 10 to
15 percent of the body as a whole, which rating customarily
amounts to between $1470. 00 and $2205. 00 excluding the
attorney' s fee, and
WHEREAS, the City has voluntarily paid benefits
for permanent disability amounting to $735. 00,or 5 percent
permanent partial disability of the body as a whole based
upon Dr. Lyle Russell ' s rating, and
WHEREAS, it is felt by the Legal Department that
it is in the best interest of the City to enter into a
compromise settlement stipulation under the provisions of
§440. 20 (10) , Fla. Statutes, as amended 1967, such settlement
to be in the total approximate amount of $980. 00, which is
equal to an additional 5 percent permanent partial disability
of the body as a whole, making a composite permanent disability
of 10 percent of the body as a whole, and
WHEREAS, payment of the sum hereinbefore set forth
will discharge forever the City' s liability of every description
for past, present, and future Workmen ' s Compensation benefits
payable as a result of the accident of June 24, 1967, and
WHEREAS, the Order of the Judge of Industrial
Claims approving the settlement stipulation will not be
subject to modification or review, and
WHEREAS, the City Council deems it to be in the
best interest of the City to enter into a final settlement
stipulation hereinbefore set forth.
NOW, THEREFORE, BE IT RESOLVED BY THIS CITY
COUNCIL OF THE CITY OF MIAMI BEACH that the Legal Department
be authorized into final settlement stipulation with Edward
Bason and his attorney, and if said agreement is approved
by the Judge of Industrial Claims, the Mayor, and City Clerk
and Finance Director be, and they are hereby authorized and
directed to comply with the Order of the Judge approving
said stipulation.
