Resolution 12605 RESOLUTION NO. 12605 WHEREAS the City Council of the City of Miami Beach, Florida, on the application of S .P.J. Corporation and Wellington Industries, Inc. , is considering the location and fixing of a bulkhead line and the granting of a dredge-and-fill permit offshore from the following described parcel of land westerly from a portion of Block ? of the AMENDED PLAT OF SECOND OCEAN FRONT SUBDIVISION, Plat Book 23 at page 207 and easterly of a portion of INDIAN CREEK SUBDIVISION, Plat Book 31 at page 75, all of the Public Records of Dade County, Florida; said parcel of land bordering on Indian Creek, the same constituting navigable waters , as defined in Section 253 . 12 , Florida Statutes ; and WHEREAS the City Council of the City of :Miami Beach, Florida, is authorized, under the provisions of Section 253 . 122 and Section 253 . 124, Florida Statutes, 1967, to locate and fix such bulkhead line and to grant a dredge-and-fill permit upon the application of S .P.J. Corporation and Wellington Industries, Inc. , provided that a public hearing is held pursuant to the provisions of said Sections 253. 122 and 253.124; NOW, THEREFO:RE, BE IT DULY RESOLVED by the City Council of the City of Miami Beach, Florida, that a public hearing be and the same is hereby called to be held on the 19th day of February, 1969, at 3 :30 o 'clock P.M. in the Council Chambers, City Hall, Miami Beach, Florida, for the purpose of determining whether a bulkhead line in Indian Creek offshore from the parcel of land hereinabove described shall be fixed and located as follows : Begin at a point on the North right of way line of 63rd Street at a distance of 290 feet, more or less , East of, as measured at right angles to, the easterly boundary line of INDIAN CREEK SUBDIVISION, according to the Plat thereof recorded in Plat Book 31 at Page 75 of the Public Records of Dade County, Florida; thence run in a northerly direction along a line for a distance of 1056 feet, more or less, to the intersection thereof with the prolongation westerly of the North line of Lot 12 , Block 3 of the AMENDED PLAT OF SECOND OCEAN FRONT SUBDIVISION, according to the Plat thereof recorded in Plat Book 23 at page 28 of the Public Records of Dade County, Florida, said point being 49 feet, more or less, westerly of the westerly line of Block 3 of the said AMENDED PLAT OF SECOND OCEAN FRONT SUBDIVISION and also being a point 3.0 feet westerly of, as measured along the prolongation westerly of the North line of the said Lot 12 , an existing seawall ; thence run easterly along the prolongation westerly of the North line of the said Lot 12 for a distance of 0. 0 feet to a point on an existing seawall ; thence run southerly along the faces of existing seawalls to a point on the North right of way line of 63rd Street, the same being the Point of Beginning of the parcel of submerged land herein described. LESS : Begin at a point on the prolongation westerly of the North line of Lot 1, Block 3 -1- of the AMENDED PLAT OF SECOND OCEAN FRONT SUBDIVISION, according to the plat thereof recorded in Plat gook 23 at page 23 of the Public Records of Dade County, Florida, said point being 40 feet, more or less, westerly of the westerly line of Block 3 of the said AMENDED PLAT OF SECOND OCEAN FRONT SUBDIVISION, and also being the northwesterly corner of an existing seawall ; thence run northerly along a line for a distance of 577 feet, more or less, to the intersection thereof with the prolongation westerly of the North line of the North 3/4 of Lot 8, Block 2 of the said AMENDED PLAT OF SECOND OCEAN FRONT SUBDIVISION, said point being 32 feet, more or less, westerly of the westerly line of Block 3 of the said AMENDED PLAT OF SECOND OCEAN FRONT SUBDIVISION, and also being a point on the Southwest corner of an existing seawall ; thence run easterly along the southerly face of an existing seawall and along the prolongation westerly and along the North line of the North 3/4 of Lot 3, Block 3 of the said AMENDED PLAT OF SECOND OCEAN FRONT SUBDIVISION for a distance of 41 .5 feet, more or less, to the Northeast corner of an existing seawall ; thence run southerly along the face of an existing seawall for a distance of 512 feet, more or less, to the Southeast corner of an existing seawall and a point on the prolongation westerly of the North line of Lot 1, Block 3 of the said AMENDED PLAT OF SECOND OCEAN FRONT SUBDIVISION; thence run westerly along the face of an existing seawall and along the prolongation westerly of the North line of Lot 1, Block 3 of the said AMENDED PLAT OF SECOND OCEAN FRONT SUBDIVISION for a distance of 30.35 feet, more or less, to the Point of Beginning; as well as to determine whether a dredge-and-fill permit be granted concerning said submerged lands hereinabove described; BE IT FURTHER RESOLVED by the City Council of the City of Miami Beach, Florida, that the City Clerk and Finance Director be and she is hereby authorized and directed to give thirty (30) days ' notice of the time, place and objective of the said hearing, by public notice thereof to be published for three (3) consecutive weeks in the Miami Beach Times, a newspaper of general circulation in Dade County, Florida. BE IT FURTHER RESOLVED that the City Clerk and Finance Director be and she is hereby authorized and directed to send copies of such notice by certified or registered mail to each riparian owner of upland lying within one thousand (1, 000) feet of the proposed bulkhead line.
