Resolution 11934 RESOLUTION NO. 11934
WHEREAS, the owner of the fee simple title in and to
Lots Nos. 1, 2 and 3, Block 3, of ORCHARD SUBDIVISION NO. 4,
according to the plat thereof, recorded in Plat Book 25, at
page 30 of the public records of Dade County, Florida, has
requested that the City of Miami Beach relinquish all of its
right, title and interest in and to that certain easement
over a strip five feet wide at the rear of said lots and along
the east side of said Lot 3, which was reserved by the grantor
in that certain warranty deed conveying said property dated
July 28, 1934, and recorded in Deed Book 1573, at page 313
of the public records of Dade County, Florida, for the use
of wire lines, pipe lines, sewers and other municipal public
utility facilities; and
WHEREAS, the City of Miami Beach has ascertained,
through its Engineering Department, that it has no municipal
utilities located in the easement hereinabove described, and
that the various public utility companies in the area have
either relinquished all of their right, title and interest in and
to said easement or are working with the present owner of the
property hereinabove described to effectuate a release of their
rights, if any, in and to said easement; and
WHEREAS, the City Council of the City of Miami Beach,
Florida has found and determined that there is no need, either
for the present or in the foreseeable future, for said easement;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the said easement,
hereinabove described and contained in that certain warranty
deed dated July 28, 1934, and recorded in Deed Book 1573, at
page 313 of the public records of Dade County, Florida,
be and the same is hereby relinquished and surrendered.
