A RESOLUTION APPROVING ACCEPTANCE OF OFFER
OF SETTLEMENT ON CERTAIN PARCELS OF LAND
TO BE ACQUIRED IN THE CITY OF MIAMI BEACH,
FLORIDA.
WHEREAS , the City Council of the City of Miami Beach,
Florida, heretofore authorized institution of condemnation
proceedings for the acquisition of the fee simple title to the
following described parcels of land, to wit:
PARCEL NO. SIX:
Lot 4, Block 12, ALTOS DEL MAR NO. 2 ,
according to the Plat thereof recorded
in Plat Book 4 at page 162 , of the Public
Records of Dade County, Florida,
(commonly known as 8616 Collins Avenue)
PARCEL NO. SEVEN:
Lot 5, Block 12, ALTOS DEL MAR NO. 2,
according to the Plat thereof recorded
in Plat Book 4 at page 162 , of the Public
Records of Dade County, Florida,
(commonly known as 8612 Collins Avenue)
PARCEL NO. EIGHT :
Lot 6 , Block 12, ALTOS DEL MAR NO. 2 ,
according to the Plat thereof recorded
in Plat Book 4 at page 162 , of the Public
Records of Dade County, Florida,
(commonly known as 225 - 86th Street)
for use for public park and recreational purposes ; and
WHEREAS , pursuant to said resolution, appropriate
condemnation proceedings were instituted in the Dade County
Circuit Court for said purpose, said proceedings entitled City
of Miami Beach v. Joe Kasdin, et al. , being Case No. 72-21184 ;
and
WHEREAS , said parcels of land were appraised by the
City' s appraisers , as follows :

Statewide Appraisal Services , Inc. $60 , 000 . 00
PARCEL NO. SEVEN:
Cole Appraisal Company $64 , 325. 00
Statewide Appraisal Services , Inc. $65 , 800 . 00
PARCEL NO. EIGHT :
Cole Appraisal Company $66 , 060. 00
Statewide Appraisal Services , Inc. $64 , 600 . 00
and
OFFICE OF THE CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139
WHEREAS , prior to impanelling of a jury, proposed
offers of settlement were made by the owners of said parcels ,
by and through their attorney, as follows :
PARCEL NO. SIX:
To Estelle Zara Kutun, Harold P . Lefcourt,
Morris H. Kantzler, as co-trustees of the
Herman W. Lefcourt Trust, the sum of
$60 , 755. 86 , plus the sum of $6 , 075. 59 for
attorney 's fees , the total sum being
$66 , 831 .45;
PARCEL NO. SEVEN :
To Estelle Zara Kutun, Harold P. Lefcourt,
as Remaindermen and Celia E . Lefcourt, as
Life Tenant, the sum of $68 , 642 . 04 , plus
the sum of $6 , 864 . 20 for attorney ' s fees ,
the total sum being $75 , 506 . 24 ;
PARCEL NO. EIGHT :
To Estelle Zara Kutun, Harold P. Lefcourt,
Morris H. Kantzler, as trustees of Celia
Lefcourt Marital Trust, the sum of
$69 ,409 . 98, plus the sum of $6 , 941. 00 for
attorney 's fees , the total sum being
$76 , 350 . 98 ;
and a consent Judgment to be entered accordingly; and
WHEREAS , the City Attorney, the City Manager, Mr. S .
Z . Bennett, the City ' s former Real Estate Consultant who completed
this particular transaction from a sense of commitment to this
project and without any added compensation, and Mr. John R.
Farrell, Special Counsel for the City, have each recommended to
the City Council that the acceptance of said offers of settlement
are financially advantageous to the City and in its best
interests ; and
WHEREAS , the City Council of the City of Miami Beach,
Florida, has duly considered said offers of settlement and said
recommendations , and now being fully advised in the premises ,
it is , therefore,
RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA, that the said offers of settlement, as hereinabove
recommended, be and the same are hereby accepted and the City
Attorney be and he is hereby authorized and directed to take all
legal steps necessary to effectuate and execute said offers of
settlement, and the proper financial officers of the City be and
they are hereby authorized and directed to make all payments
pursuant to said Judgments as required by law.
