Morales, City Manager 1` DATE: January 10, 2019 SUBJECT: DISCUSSION REGARDING THE L ND USE AND DEVELOPMENT COMMITTEE'S (LUDC) ACTION ON RIDESHARE (COMMISSION ITEM R9I — WITHDRAWN) - UPDATE The purpose of this Letter to Commission is to provide an update regarding allowing the potential use of taxi stands by rideshare providers. At the October 31, 2018, LUDC meeting the following action was taken as part of the discussion on Rideshares: Motion (By Acclamation): 1. Continue the item to the November 28, 2018 LUDC meeting. 2. Recommend that an R9 discussion item be placed on an upcoming City Commission agenda to discuss requesting a change to the Miami-Dade County Code regarding taxi stands. Miami-Dade County regulates taxi stands and a change in use would require approvals from Miami-Dade County, including an amendment to the Miami-Dade County Code. As a follow-up to this initiative, Commissioner Aleman inquired with Miami-Dade County Commissioner Higgins as to the feasibility of utilizing existing taxi stand by rideshare companies. In turn, Commissioner Higgins inquired with the County Attorney's Office regarding any legal pre-emptions for this use. The County Attorney's Office advised that municipalities are totally pre-empted by the state and therefore blocked from making this change. The statute specifically states that TNCs (Transportation Network Companies) are governed exclusively by state law. There are two exceptions and both are only for the airport and seaport. As a result, Item No. R91, entitled, "Discussion Regarding The Land Use And Development Committee's Action On Rideshare" on the January 16, 2019, City Commission Agenda has been withdrawn.
