A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO
STIPULATE TO ENTRY OF THE ORDER REQUESTED IN
THE CASE OF STATE OF FLORIDA, ETC. V. CITY
ELECTIONS CANVASSING BOARD.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FLORIDA, that the City Attorney be and h:e is hereby
authorized and directed to agree to and to stipulate to the entry
of an order authorizing the opening of absentee ballots as prayed
for in that certain suit, filed on behalf of the State of
Florida, by Richard E. Gerstein, versus the City Council of the
City of Miami Beach, Florida, and ex .officio Elections Canvassing
Board of said City, authorizing the Dade County Public Safety
Department to open certain absentee ballots cast in the City of
Miami Beach Council Election held on November 4 , 1975 and
described in said complaint, the purposes of said opening being
described in said Complaint, filed in the Circuit Court of
Dade County.
PASSED and ADOPTED this 17th day of March , 1976 .
