A RESOLUTION AUTHORIZING ACCEPTANCE OF GRANT OF
NEW EASEMENT IN EXCHANGE FOR CITY 'S RELINQUISH-
. MENT OF EXISTING EASEMENT INVOLVING LOTS 1 AND
1-A, BLOCK 4 , $LAMINGO TERRACE ADDITION, PLAT
BOOK 34 , PAGE 68 .
WHEREAS , the owners of Lots 1 and 1-A, Block 4,. FLAMINGO
TERRACE ADDITION, according to the plat thereof, recorded in Plat
Book 34 , Page 68 , of the Public Records of Dade County, Florida,
have requested that the City of Miami Beach abandon an existing
six-foot easement, dedicated to the City of Miami Beach and to
franchised public utility companies for the purpose of installing
and maintaining gas , water and sewer lines and power, telephone
and telegraph lines , said easement being located along the
easterly three feet of Lot 1 and the westerly three feet of Lot 1-A,
Block 4 , FLAMINGO TERRACE ADDITION, Plat Book 34, Page 68, in
exchange for a five-foot easement along the northerly five feet of •
Lot 1-A, Block 4 , and the northerly five feet of the easterly three
feet of Lot 1 , Block 4 , of said FLAMINGO TERRACE ADDITION, and
WHEREAS , the City of Miami Beach presently has yet made
no use of said easement, but that if said exchange of easements is
accomplished, the City of Miami Beach will possess a suitable and
appropriate easement from Flamingo Drive to Lake Pancoast for the
installation and maintenance of appropriate storm sewers and water
lines, and
WHEREAS, the City Manager and the Public Works Department
of the City have recommended to the City Council that such proposed
exchange of easements be accomplished;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that the offer of the owners of said
Lots 1 and 1-A, of Block 4, of said Subdivision, be and the same is
hereby accepted, and the City Attorney be and he is hereby authorized
and directed to prepare for the signature of the Mayor ,and attestation
of the City Clerk, all deeds and instruments necessary to accomplish
said exchange of easements , and to accept, for and on behalf of the
City of Miami Beach, the delivery of such grant of easement by the
owners;� ,and to deliver to the said owners an appropriate instrument
whereby the City vacates , relinquishes and surrenders the existing
easement as hereinabove described;
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that the accomplishment of said exchange
of easements be and the same is hereby expressly conditioned upon
the proviso that all existing public utility companies likewiee
agree and consent to such easements .
