Resolution 76-15004 RESOLUTION NO. 76-15004 A RESOLUTION PETITIONING THE LEGISLATURE OF THE STATE OF FLORIDA TO ENACT LEGISLATION FOR RELIEF OF THE CITY OF MIAMI BEACH, REIMBURSING THE CITY OF MIAMI, BEACH FOR EXPENDITURES MADE IN COMPLIANCE WITH ORDERS OF THE FLORIDA STATE BOARD OF HEALTH FOR THE CONSTRUCTION OF A SEWAGE OCEAN OUTFALL. WHEREAS , the City of Miami Beach, in compliance with orders and mandates of the Florida State Board of Health, did construct an Ocean Sewage Outfall, and • WHEREAS , the cost of construction of said Outfall was $3,047 ,422. 26 , all as shown by a tabulation of costs and expenditures prepared by the Public Works Department of the City, which tabulation is attached hereto and made a part hereof, as Exhibit A, and WHEREAS , the cost of construction of said Outfall was in part financed by the issuance of General Obligation Bonds of the City of Miami Beach, on which there is due and unpaid, as of this date, the sum of $915,000. 00 representing principal, and accrued interest in the amount of $415,332. 00, as shown by the attached tabulation, prepared by the Chief Accountant of the City, which tabulation is also attached hereto and made a part hereof, as Exhibit B, and WHEREAS , the Legislature, by the enactment of Chapter 403, Florida Statutes , has mandated and ordered the abandonment and destruction of said Ocean Outfall, and WHEREAS , it is deemed fair and equitable that the City of Miami Beach be reimbursed for the cost of constructing said Sewage Ocean Outfall , which expenditure was made pursuant to and in accordance with the mandate of the Florida State Board of Health, a duly authorized agency of the State of Florida; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager and the,,.City Attorney of the City of Miami Beach be and they are hereby instructed and directed to take all necessary steps to procure the enactment by the State Legislature of the State of Florida, of appropriate legislation authorizing and directing the appropriation from funds of the State of Florida, in the sum of $3, 047,422 . 26 , said sum to be paid to the City of Miami Beach, as fair and equitable compensation for monies expended by directives of the State of Florida, and that all necessary andpproper steps be taken by the said City Manager and City Attorney to the attention of the . Legislature and appropriate State officials for the enactment of said act for the relief of the City of Miami Beach. PASSED and ADOPTED this 31st day.' March, 1976.
