Resolution 76-15019 RESOLUTION NO. 76-15019 A RESOLUTION APPROVING AND ACCEPTING SETTLE- MENT OF CIVIL RIGHTS CASE AGAINST THE CITY OF MIAMI BEACH ENTITLED EILEEN FEINBERG, ETC. V. NELAN SWEET, ET AL. , IN THE AMOUNT OF $1,500 . WHEREAS , there is pending in the United States District Court, Southern District of Florida, certain civil rights litigation entitled, Eileen Feinberg, etc. v. Nelan Sweet, et al. , in which the Court found that the plaintiff's civil rights had been violated by .City of Miami Beach personnel, and that the said cause is now set for trial on the question of damages sustained by the plaintiff, and WHEREAS, the insurance carrier for the City of Miami Beach has disclaimed responsibility for the defenses of this cause by virtue of the express provisions of the City's insurance policy, and • WHEREAS , the City Attorney, the City Manager, and the City ' s Police Chief have recommended to the City Council that it is to the best advantages of the City and its taxpayers that the said cause be settled and compromised in the amount of $1, 500. 00 , and WHEREAS, the City Council of the City of Miami Beach deems and finds it to be in the best interests of the City of Miami Beach and its taxpayers that said compromise and settlement 'be accepted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the proper financial officers of the City be and the are hereby authorized and directed to pay Steven Wisotsky, attorney for the plaintiff, the sum of $1, 500 .00 for and on behalf of his client, as full settlement, for release and discharge of all her claims against the City of Miami Beach and all other defendants: in said cause, and that the said payment be charged to the operations of the City of Miami Beach Police Department.
