A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, AUTHORIZING ACCEPT-
ANCE OF OFFER BY FISHER'S ISLAND, INC. TO
GRANT THE CITY EASEMENTS ACROSS FISHER ISLAND
FOR SEWAGE TRANSMISSION LINES TO VIRGINIA KEY
AT A TOTAL COST TO THE CITY OF $5, 000 AS JOINT
ATTORNEYS ' FEES THEREBY AVOIDING NECESSITY OF
PROCEEDING FURTHER WITH THE CONDEMNATION SUIT.
WHEREAS , the City Council of the City of Miami Beach,
Florida, at its regular meeting of August 6 , 1975, adopted
Resolution No. 75-14784 , authorizing and directing the City
Attorney to institute necessary legal proceedings against certain
properties on Fisher Island for acquisition of perpetual ease-
ments for force mains for transmitting sewage to the Virginia
Key Sewage Treatment Plant, and for construction easements in
connection therewith; and
WHEREAS , pursuant to said Resolution, the City Attorney
filed suit in the Circuit Court of the Eleventh Judicial Circuit
of Florida, in and for Dade County, being entitled City of Miami
Beach vs . Fisher 's Island, Inc. and Peoples American National Bank
of North Miami, being Case. No . 75-38664; and
WHEREAS, an offer was made by Fisher 's Island, Inc.
to grant the City the easements across Fisher Island for Sewage
Transmission Lines to Virginia Key, at a total cost to the City
of Five Thousand Dollars ($5,000. 00) , as a joint attorneys ' fee,
thereby avoiding the necessity of proceeding further with the
pending condemnation suit; and
WHEREAS , the City Attorney has recommended to the City
Council that said offer should be accepted; and
WHEREAS , the City Council has found and determined that
the acceptance of said offer is in the best interests of the City,
its citizens and residents;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that said offer made by Fisher' s
Island, Inc. , at a total cost of $5 , 000 . 00 . to the City, as here-
inabove set forth, be and the same is hereby accepted, approved
and authorized; and the financial officers of the City be and they
are hereby authorized and directed to disburse the monies required
hereby and hereunder from funds of the City available for said
purpose.
