Resolution 76-15039 RESOLUTION NO. 76-15039 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, REQUESTING THE LEGISLATURE OF THE STATE OF FLORIDA TO ENACT INTO LAW THAT CERTAIN CLAIMS BILL NOW PENDING IN THE HOUSE OF REPRESENTATIVES FOR AND ON BEHALF OF THE CITY OF MIAMI BEACH REIMBURSING SAID CITY FOR THE COST OF CONSTRUCTION OF ITS OCEAN SEWAGE OUTFALL, ' INSTALLED T. UNDER A MANDATE OF THE STATE OF FLORIDA, AND NOW REQUIRED TO BE DESTROYED BY STATE MANDATE. WHEREAS , there is now pending in the House of Representa- tives a Claims Bill for and on behalf of the City of Miami Beach to provide for the reimbursement of said City for the cost of an ocean sewage outfall constructed under order and mandate of the Stateoof Florida, and now required to be destroyed by order and mandate of the State of Florida, all as set forth in said Claims Bill; and WHEREAS , the City of Miami Beach did heretofore, under direct orders and requirements of the then Florida State Board of Health, construct and maintain an ocean sewage outfall at a cost • to the City of $3, 047, 422 . 26; and WHEREAS, the City of Miami Beach, in complete good faith, fully complied with said orders of the State of .Florida; and WHEREAS , under existing State legislation, the City of Miami Beach is ordered and mandated to destroy said sewage ocean outfall resulting in a direct financial loss to the City of Miami Beach and its taxpayers of said $3, 047 ,422. 26; and WHEREAS , the City off -Miami Beach is now under mandate of the State of Florida and its agencies to expend a further and addi- tional sum in excess of $10 ,000 , 000 for a replacement sewage system; and WHEREAS , fairness , equity and good conscience require and demand that the City of Miami Beach and its taxpayers be reimbursed for the loss and expense of $3, 047 ,422. 26 thus caused it by its good faith reliance upon the orders and dictates of the State of Florida and its agencies; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY -OF MIAMI BEACH, FLORIDA, that the House Committee on Retirement, Personnel and Claims be and it is hereby respectfully petitioned s to favorably consider, and recommend for adoption by the House of Representatives , the enactment of said Bill for the relief of the City of Miami Beach; and • BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that each and every member of the Florida • House of Representatives and of the Senate of the State of Florida be apprised and duly informed of the foregoing, and that they, and each of them, be and they are hereby respectfully petitioned to favorably consider and enact into law said Bill for the relief of the City of Miami Beach; and • BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that copies of this resolution be trans- mitted to the Hon. Dempsey J. Barron, President of the Senate; the Hon. Donald L. Tucker, Speaker of the House of Representatives; members of House Committee on Retirement, Personnel and Claims ; each member of the Dade County Delegation to the House and Senate; and the Dade County Coordinating Council . -,*' PASSED and ADOPTED this 5th ,,d" f of May, 1976.
