A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, PROVIDING FOR THE
USE AND APPLICATION OF FUNDS RECEIVED FROM
THE STATE OF FLORIDA PURSUANT TO CLAIMS BILL
SB 1316 , RELATING TO THE CITY' S OCEAN OUTFALL.
WHEREAS, the City of Miami Beach has filed with the
Legislature of the State of Florida a Claims Bill (SB 1316) for
reimbursement to the City of Miami Beach for the construction
costs of the City' s ocean outfall; and
WHEREAS, the City Council of the City of Miami Beach, by
this resolution, does hereby express its intention with respect to
the use and application of funds received from the State of Florida
pursuant to said Claims Bill SB 1316;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, as follows:
Section 1. It is the specific intention and purpose of
the City of Miami Beach to apply all funds received from the State
of Florida pursuant to Claims Bill SB 1316 for the exclusive
purpose of repaying the amount of the bonded indebtedness incurred
by the City of Miami Beach for the construction of the City of
Miami Beach ocean outfall.
Section 2 . This resolution has the force and effect of
a binding contractual obligation on the part of the City of Miami
Beach, Florida, with respect to the use and application of said
funds.
Section 3. The City Clerk shall forthwith transmit a
certified copy of this resolution to D. Stephen Kahn, Special
Master for the Florida Senate, and to Thomas F. Woods, Special
Master for the Florida House of Representatives.
Section 4. This resolution shall take effect immediate-
ly upon its passage and approval as provided by law.
