A RESOLUTION AUTHORIZING AN AMENDMENT TO THE
EXISTING LEASE AGREEMENT BETWEEN THE CITY OF
MIAMI BEACH AND MIAMI BEACH SYMPHONY ORCHESTRA.
WHEREAS, the CITY OF MIAMI BEACH entered into a lease
agreement with MIAMI BEACH SYMPHONY ORCHESTRA, dated August 17,
1977, and
WHEREAS, said MIAMI BEACH SYMPHONY ORCHESTRA has requested
an amendment to said existing lease agreement to provide for the
deletion of the March 7 , 1978 concert from said lease agreement,
and
WHEREAS, all other terms and conditions of the existing
agreement shall remain the same, except consideration for use of
the facilities will be as follows:
Seven Thousand Dollars ($7, 000. 00) total minimum
guarantee based on One Thousand Dollars ($1, 000. 00)
for each concert. Lessor has the privilege of
accepting the minimum guarantee or Twelve percent
(12%) of the gross receipts from sale of admission
• tickets, after taxes, whichever sum is greater for
each concert.
Lessee agrees to deposit with lessor, upon execu-
tion and delivery of this instrument the sum of
One Thousand Dollars ($1, 000. 00) , receipt whereof
is hereby acknowledged; Six Thousand Dollars
($6, 000. 00) payable on or before November 13,
1977, receipt whereof is hereby acknowledged; and
final settlement of any percentage balance due on
each of the above concerts, payable by May 20,
1978,
and
WHEREAS, a letter, signed by the Director of the Miami
Beach Convention Center, dated February 21, 1978, amending the
existing agreement between the CITY OF MIAMI BEACH and MIAMI BEACH
SYMPHONY ORCHESTRA has been mailed to and accepted by said MIAMI
BEACH SYMPHONY ORCHESTRA;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the said amendment as set
forth in said letter dated February 21, 1978, signed by the Direc-
tor of the Miami Beach Convention Center, to the existing agreement
between the CITY OF MIAMI BEACH and MIAMI BEACH SYMPHONY ORCHESTRA
be and the same is hereby accepted and approved in the name of and
on behalf of said CITY.
