Resolution 78-15550-A RESOLUTION NO. 78-15550 A A RESOLUTION REQUESTING MIAMI-DADE WATER AND SEWER, AUTHORITY TO CONTACT THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY TO ASCERTAIN WHETHER THEY WILL ENTERTAIN AN APPLICATION FROM DADE COUNTY UNDER THE CLEAN WATER ACT OF 1977 TO MODIFY THE SECONDARY TREATMENT REQUIREMENT OF THE VIRGINIA KEY WASTE- WATER TREATMENT PLANT. WHEREAS, the City of Miami Beach has a contract with the Miami-Dade Water and Sewer Authority for, the construction of a connection to the wastewater treatment plant at Virginia Key and for the disposal of the City' s sewage at said plant; and WHEREAS, Public Law 92-500, the Federal Water Pollution Control Act, Amendments of 1972, was amended on December 27, 1977, by Public Law 95-217, commonly referred to as the "Clean Water Act of 1977" ; and WHEREAS, Section 1311 (h) of said Clean Water Act of 1977 provides a procedure and certain criteria for a modification of discharge requirements of any pollutant in an existing discharge from a publicly owned treatment works into marine waters if certain conditions are met; and WHEREAS, it would be in the City' s best interests to use deep current assimiliation, said deep current assimiliation being a permissible modification of the discharge requirement under the provisions of the Clean Water Act of 1977, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that Miami-Dade Water and Sewer Authority is requested to contact the United States Environmental Protection Agency to ascertain whether they will entertain an application from Dade County under the Clean Water Act of 1977 to modify the secondary treatment requirement of the Virginia Key Wastewater Treatment Plant.
