A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH AUTHORIZING THE ASSIGNMENT
OF AIR RIGHTS LEASE, AS AMENDED, AND LEASE FOR
25 PARKING SPACES FROM SENIOR CITIZENS HOUSING
DEVELOPMENT CORPORATION OF MIAMI BEACH TO THE
MIAMI BEACH SENIOR CITIZENS HOUSING DEVELOPMENT
CORPORATION, INC. (SIXTH STREET)
WHEREAS, the lessee of that certain 50-year air rights
lease entered into by the City of Miami Beach, pursuant to Resolu-
tion No. 76-15085, as amended, and of that certain lease of 25
parking spaces authorized under the provisions of Resolution No.
76-15089 of the City Council of the City of Miami Beach, has
requested the approval and consent of the City Commission of the
City of Miami Beach for the assignment by said lessee of all its
right, title and interest in and to said leases described in said
Resolution Nos. 76-15085, as amended, and 76-15089 to The Miami
Beach Senior Citizens Housing Development Corporation, Inc. , and
WHEREAS, the City Commission of the City of Miami Beach,
Florida, deems and finds that good and sufficient reason exists
for such requested assignment and that it is in the best interests
of the City of Miami Beach and its citizens and residents that
said assignmentsbe agreed to and approved;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the assignment of said
leases authorized and described in said Resolution Nos. 76-15085,
as amended, and 76-15089 be and the same is hereby authorized and
approved, and that the said Miami Beach Senior Citizens Housing
Development Corporation, Inc. , a non-profit Florida corporation,
be and the same shall be deemed and shall be taken to be the
lessee for all intents and purposes as though it had been named
and designated as lessee in the first instance and that the said
corporation as said assignee/lessee shall be deemed to be bound by
each and every covenant of the said leases as fully and for all
purposes and as if and as though it had been named and designated
lessee in the first instance;
BE IT FURTHER RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk be and
they are hereby authorized to execute and deliver any and all
instruments deemed necessary and proper for the fulfillment of the
object, purpose and intent of this Resolution to the said lessee.
