A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH CALLING UPON METROPOLI-
TAN DADE COUNTY TO FUND AND FINANCE THE
COST OF BEACH PATROL.
WHEREAS, the City of Miami Beach is and has been bearing
the heavy and exclusive burden of funding the cost of the City of
Miami Beach Beach Patrol, and
WHEREAS, the City of Miami Beach Beach Patrol renders a
service which is substantially for the benefit of all of the citi-
zens of Dade County, and
WHEREAS, it is provided by the Constitution and the
Statutes of the State of Florida that Dade County is forbidden to
levy taxes upon property of City residents to pay the cost of
services which are rendered substantially for the benefit of
County residents, and
WHEREAS, the Metropolitan Home Rule Charter specifically
provides the mechanism whereby Dade County can contract with the
City of Miami Beach for the rendition of Beach Patrol services,
and

WHEREAS, the City of Miami Beach Beach Patrol is acknowl-
edged to be the finest and best trained Beach Patrol corps in the
Nation, and
WHEREAS, it is to the benefit of all of the citizens of
Dade County to maintain the Miami Beach Beach Patrol in its pre-
sent status, and
WHEREAS, it is unconstitutional and inequitable for ,the
City of Miami Beach and its taxpayers to continue funding the cost
of said Beach Patrol;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that Metropolitan Dade County be
and it is hereby called upon to assume its proper constitutional,
legal and equitable obligations by forthwith agreeing to finance
the cost of operating and maintaining said Beach Patrol and to
remit the amount of the identified cost thereof to the City of
Miami Beach commencing with the fiscal year 1978/1979 .
BE IT FURTHER RESOLVED BY THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH„ FLORIDA, that the County Manager be and he is
hereby respectfully called upon to meet, with all reasonable
promptitude, with this City Commission to devise ways and means to
accomplish the foregoing resolve;
BE IT FURTHER RESOLVED BY THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH; FLORIDA, that copies of this Resolution be trans-
mitted to the Mayor, the Commissioners and the County Manager of
Metropolitan Dade County and to the several newspaper, television
and radio media.
