A RESOLUTION AUTHORIZING EXECUTION OF AGREE-
MENT WITH OPTIMIST CLUB OF IVES ESTATES FOR
A RENEWAL OF AN ANNUAL LEASE OF A PORTION OF
THE CITY' S "OJUS" DUMP PROPERTY, " COMMENCING
OCTOBER 1, 1978 , TO SEPTEMBER 30 , 1979 .
WHEREAS, the Optimist Club of Ives Estates, has requested
• a renewal of an annual lease. of a portion of the City' s "Ojus Dump
. Property, " for a period commencing October 1, 1978 , and terminating
on September 30 , 1979 , for use as playground facilities , and
WHEREAS , appropriate insurance policies have been procured
by said Optimist Club in accordance with the requirements of the
City Manager, and
WHEREAS, the City Manager has recommended the entry into
. of an agreement extending said lease for said period of time, and
WHEREAS, an appropriate agreement with the Optimist Club
of Ives Estates has been prepared and has been approved as to form
by the City Attorney, the terms and conditions of which are set
forth in said agreement, a copy of which is attached hereto and made
a part hereof, and
WHEREAS, the City Commission of the City of Miami Beach
deems it to be in the best interests of the City and its residents
to enter into said agreement; '
NOW-, .THEREFORE., BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk be
and they are hereby authorized and directed to execute said agree-
ment on behalf of the City of Miami Beach, Florida.

THIS AGREEMENT, made and entered into this 15th day
of November , 1978 , by and between the CITY OF MIAMI
BEACH, a Florida municipal corporation, its successors and
assigns, hereinafter called the "CITY" , and OPTIMIST CLUB OF
IVES ESTATES, a Florida non-profit corporation, its successors
and assigns, hereinafter called the "CLUB" ,
WITNESSETH:
WHEREAS, the CITY is the owner of a certain parcel of
land in Dade County, Florida, commonly known as the OJUS DUMP
PROPERTY, and the CLUB desires to use a portion thereof for
recreational purposes; and
WHEREAS, the parties hereto had heretofore entered
into an Agreement dated June 22, 1966, which terminated on
February 24, 1967; and
WHEREAS, the parties hereto, by mutual understanding,
have, from time to time, renewed the same, and the last of said
Agreements expires on September 30, 1978; and
WHEREAS, the parties hereto desire to continue the
said Agreement for an additional period of one '(1) year, termi-
nating on September 30, 1978;
NOW, THEREFORE, in consideration of the sum of One
Dollar ($1. 00) paid to the CITY by the CLUB, and in ' further
consideration of the mutual covenants herein contained, it is
agreed as follows:
1. That the original Agreement between the parties
hereto, dated June 22 , 1966 , for the use of a portion of the
property owned by the CITY in the unincorporated area of Dade
County, more particularly described therein, and commonly known
as the CITY OJUS" DUMP PROPERTY, for recreational purposes by

the youth, and other groups in the area, be and the same is
hereby extended for an additional period of one (1) year, termi-
nating on September 30 , 1979.
2 . That said Agreement, as hereby extended, shall be'
upon the same terms and conditions as the original Agreement, and
said original Agreement, except as hereby renewed and extended,
shall be deemed incorporated herein as fully, and for all purposes,
as though herein in haec verba.
IN WITNESS WHEREOF, the parties hereto have hereunto
set their hands and seals by their officers duly authorized, the
, day and year first above written.
