A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
MIAMI BEACH , FLORIDA , AUTHORIZING AND DIRECTING THE
EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF MIAMI
BEACH AND ROBERT L . SHEVIN .
WHEREAS , the City Commission of the City of Miami Beach ,
Florida , did appoint Robert L . Shevin as City Attorney of the
City of Miami Beach ; and
WHEREAS , said Robert L . Shevin is a member of the Law
Firm of Sparber , Shevin , Rosen , Shapo & Heilbronner ;
NOW , THEREFORE , BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH , FLORIDA, that the Mayor and City
Clerk be and they are hereby authorized and directed to execute
the agreement attached hereto as Exhibit A by and between the
said City and Robert L . Shevin and providing for payment of
compensation for his services as said City Attorney to the
Law Firm of Sparber , Shevin , Rosen , Shapo & Heilbronner .

AGREEMENT
THIS AGREEMENT made and entered into this 21st .day of
February , 1979 , by and between the CITY OF MIAMI BEACH , FLORIDA ,
and ROBERT L . SHEVIN :
WITNESSET H :
The parties hereto for and in consideration of mutual
covenants herein contained each to the other made , agree and
covenant as follows :
1 . The said Robert L . Shevin agrees to act and perform
all duties of City Attorney of the City of Miami Beach , Florida ,
as required under the laws of the United States of America , the
State of Florida, Metropolitan Dade County , and the Charter ,
Ordinances , and Resolutions of the City of Miami Beach , as same
now or may hereafter exist .
2 . The City agrees to pay to the Law Firm of Sparber ,
Shevin , Rosen , Shapo & Heilbronner the sum of $4 ,000 for each
and every month that Robert L . Shevin shall serve as City
Attorney of the City of Miami Beach , Florida , said sum to be
paid at the end of each month .
3 . Except for out-of-pocket expenses such as out-of-
town travel expenses , filing , and court fees advanced , the fees
of court reporters or other various and sundry similar items ,
the compensation aforesaid shall be the sole compensation paid
for the services of the said Robert L . Shevin , it being expressly
understood and agreed that said services are being provided on a
contractual basis , and not as an employee , and that he will be
entitled to no benefits whatsoever under any City compensation
plan , the City ' s Pension System or other fringe benefit programs
as same may now or hereafter exist , other than the compensation
provided herein .
4. The effective date of this agreement shall be
February 14 , 1979 . Compensation for Ole. ni nth of February , 1979 ,

and for the last month this agreement is in effect shall be
prorated .
5 . It is understood and agreed that said Robert L .
She yin may terminate his services at any time by, giving of
notice , which notice shall be delivered to the City Clerk of
said City . The City shall have the absolute right to terminate
this agreement and Mr . Shevin ' s appointment as City Attorney by a
majority vote of its City Commission at a properly convened regu-
lar or special meeting of the City Commission of said City with
or without cause .
6 . The compensation provided for above shall include
compensation . for the incidental use by Mr . Shevin of such
facilities and personnel of the Law Firm of Sparber , Shevin ,
Rosen , Shapo & Heilbronner as he may make in the course of
his duties hereunder . The City shall provide such space ,
facilities , and budget for the operation of a Legal Department
within said City as the City Commission deems appropriate .
IN WITNESS WHEREOF , the parties hereto have executed
these presents on the day and year first above mentioned .
