Resolution 79-15893 • RESOLUTION NO. 79-15893 A RESOLUTION FOR THE MEMORIALIZATION OF THE DADE COUNTY DELEGATION TO THE FLORIDA LEGIS- LATURE TO PROCURE THE ADOPTION OF APPROPRIATE LEGISLATION OR THE EXPANSION OF SECTION 718 . 402, FLORIDA STATUTES, TO PROVIDE FOR A JUST AND • EQUITABLE MEANS OF REGULATING THE CONVERSION OF EXISTING STRUCTURES TO CONDOMINIUMS. WHEREAS, in the past 15 months in Dade County, eight buildings, ranging in size from 423 apartments to 30, were converted from rentals to condominiums and another six buildings, tliree with 450 or more apartments, went from part-condo and part-rental to condo- miniums, all together affecting more than 3, 000 apartments; and WHEREAS, the present vacancy factor of 2% of the approxi- mate 40, 000 rental units constitutes a severe emergency shortage; and WHEREAS, the conversion plan and prospect of displacement has thrown elderly tenants into a state of panic because of this scarcity of rental apartments on Miami Beach; and NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE . CITY OF MIAMI BEACH, FLORIDA, that the Dade County Delegation to the Florida State Legislature be memorialized to enact appropriate legislation to prevent the inevitable difficulties arising out of such conversions; BE IT FURTHER RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the members of the Dade County Delegation to the Florida Legislature take into consideration the following proposals: • 1. Amend Section 718. 402 , Florida Statutes, to increase • the tenant' s right to extend an expiring lease for a period in excess of the 120 days presently provided by law. 2. Adopt legislation which would require the developer to allow the tenant 60 to 90 days to give notice of their intention to exercise an option to purchase. 3 . Consider legislation which would require application of a formula for conversion which would take into consideration the length of time a tenant has resided in an apartment, thereby allowing the tenant to remain beyond the expiration of an existing lease for a period of time represented by the standard percentage of the total period of occupancy. 4 . Adopt legislation which would require that the owner/developer must obtain consent of 35% of tenants in occupancy prior to converting existing, previously occupied improvements to 'a condominium. BE IT FURTHER RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a copy of this Resolution be transmitted to each member of the Dade County Delegation to the Florida Legis- lature, to the Speaker of the House of Representatives and to the • President of the Senate of the State of Florida.
