A RESOLUTION AUTHORIZING AN APPEAL WITH
RESPECT TO RESOLUTION NO. 4-ZAB-184-79
OF THE METROPOLITAN DADE COUNTY ZONING
APPEALS BOARD.
WHEREAS, the City Commission of the City of Miami
Beach has been advised that Seaplane Service, Inc. has filed
an application with the Metropolitan Dade County Zoning Appeals
Board; and
WHEREAS, the City Commission has been advised that by
Resolution No. 4-ZAB-184-79 adopted by the Metropolitan Dade
County Zoning Appeals Board, Seaplane Service, Inc. has never
been granted permission to use a portion of land which is
situate within the City of Miami Beach for an "unusual use to
permit the maintenance and continued use of the Seaplane take
off and landing operation" ; and •
WHEREAS, the City Commission finds said action of the
Zoning Appeals Board to be contrary to the best interest of the
City of Miami Beach in. that it attemps to rezone' property sub-
ject to the exclusive zoning jurisdiction ' of the City of Miami
Beach and that it further permits a use which may not be con-
sistent with comprehensive land use Plan of the City of Miami
Beach.
NOW, THEREFORE, BE IT RESOLVED BY THE. CITY COMMISSION _,•
OF THE CITY OF MIAMI BEACH, . FLORIDA, ' that the City Attorney be
and he is authorized and directed to institute such appropriate
legal proceedings as be deemed appropriate to nullify the actions
of the Metropolitan Dade County Zoning Appeals Board concerning
the subject matter.
