A RESOLUTON OF THE CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, REQUESTING EXEMPTION
FROM TAXES ON THE REMAINING PROPERTIES ACQUIRED
BY THE CITY OF MIAMI BEACH, ON THE EAST SIDE OF
COLLINS AVENUE, BETWEEN 81ST STREET AND 87TH
STREET, MIAMI BEACH, FLORIDA, FROM THE DATE OF
ACQUISITION, OCTOBER 26 , 1976, PURSUANT TO FLORIDA
STATUTES, SECTION 196. 199 .
WHEREAS, the City of Miami Beach, Florida, has acquired
for municipal purposes, the following described properties , in
accordance with Chapter 73 of the Florida Statutes, on October 26 ,
1976 for the purchase prices hereinafter set forth in the Final
Judgment on Verdicts and Resolution No. 76-15174, attached hereto
and made a part hereof;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the City of Miami Beach
herewith formally request exemption from taxes on the property herein
set forth, from the date of acquisition thereof, pursuant to Florida
Statutes, Section 196. 199;
BE IT FURTHER RESOLVED that the certified copies of this
Resolution be transmitted forthwith to the County Manager of Dade
County, Florida, and to the various county tax officials.

RESOLUTION NO. 76-15174
A RESOLUTION AUTHORIZING PAYMENT OF JUDGMENTS
FOR ACQUISITION OF REMAINING. PROPERTIES TO BE
ACQUIRED BY THE CITY OF MIAMI BEACH, ON THE
EAST SIDE OF COLLINS AVENUE, BETWEEN 81ST STREET
AND 87TH STREET, MIAMI BEACH, FLORIDA.
WHEREAS, on June 24 , 1970 , the City Council of the City
of Miami Beach, Florida, adopted Resolution No. 13041, which
authorized institution of condemnation proceedings for the acqui-
sition of the fee simple title to those certain parcels of land
between 81st Street and 87th Street, on the east side of Collins
Avenue, Miami Beach, Florida, for parks and recreational purposes,
for the benefit of said City and its inhabitants, and
WHEREAS, pursuant to said Resolution No. 13041, appro-
priate condemnation proceedings were instituted in the Circuit
Court of the Eleventh Judicial Circuit of Florida, in and for Dade
' County, for said purpose, being entitled City of Miami Beach vs.
Amelia King Buckley, etc. , et al. , being Case No. 70-11798 , and
WHEREAS , subsequent to the institution of said proceed-
ings , negotiations took place which resulted in settlement for
purchase of parcels of land involved therein except for the
following parcels , to wit:
PARCEL NO. 2 Lot 5 , Block 2 , ALTOS DEL MAR NO. 1,
according to the Corrected Plat
thereof, recorded in Plat Book 31, at
page 40 , of the Public Records of Dade
County, Florida; Commonly known as
8111 Atlantic Way, Miami Beach.
PARCEL NO. 3 Lot 6 , Block 3 , ALTOS DEL MAR NO. 2 ,
according to the plat thereof,
recorded in Plat Book 4 , at page 162 ,
of the Public Records of Dade County,

were reached by the said jury for compensation to be made by the
City of Miami Beach for the taking of the fee simple title to the
parcels hereinbefore described, as follows :
PARCEL NO. 2 $225, 000 for the value of the land.
(No moving expenses involved. )
PARCEL NO. 3 $245 ,227 for the value of the land.
(No moving expenses involved. )
PARCEL NO. 4 $467 , 100 for the value of the land.
(No moving expenses involved. )
PARCEL NO. 5 $301, 477 for the value of the land, and
$2 , 078 . 40 as moving expenses; the total
sum being $303 , 555. 40.
and
WHEREAS, the City Council finds and determines that the
requirements of the Final Judgment in said cause creates an emer-
gency situation requiring the temporary transfer of funds from
bond funds , for the Park on the west side of Collins Avenue which
the Council finds to be a related project, and that the funds so
transferred temporarily shall be replaced at the earliest oppor-
tunity from other funds found to be available, including, but not
limited to, the use of temporarily unused funds in the existing
Community Development Block Grant Program and the creation of a
new target area, under a new and additional Community Development
Block Grant Program application, consisting of the area wherein
the parcels of land involved herein are located, and
WHEREAS, the City Attorney has advised the City Council
that he intends to take an appeal in this matter, and
WHEREAS, the City Council of the City of Miami Beach,
Florida, has duly considered said Final Judgment and is fully
advised in the premises;
NOW, THEREFORE, BE IT RESOLVED BY 'THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that payment of said Final
Judgment, as hereinbefore set forth, be and the same is hereby
authorized, and the proper financial officers of the City be and
they are hereby authorized and directed to make all payments
required by law hereby and hereunder.
