A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH OPPOSING CONSTRUCTION OF NEW
AND ADDITIONAL WATER SUPPLY MAIN TO BAL
HARBOUR AND BAY HARBOR ISLANDS .
WHEREAS, the City Council of the City of Miami Beach
has been advised that the Miami-Dade Water and Sewer Authority
is considering favorably a proposal that a new water main be
constructed to cross the Broad Causeway so as to supply the
Town of Bay Harbor Islands and the Village of Bal Harbour with
water and that the existing City of Miami Beach water mains be
placed in a standby category only after the completion of said
new transmission lines, and
WHEREAS, the City Council of the City of Miami Beach,
Florida, has found and determined that the construction of said
proposed new water main by the Miami-Dade Water and Sewer Authority
would constitute a breach of a contract found by the courts to exist
between the City of Miami Beach and North Bay Village, Bal Harbour
and Bay Harbor Islands for the supply of water by the City of Miami
Beach to said municipalities and would also result in substantial
financial loss and detriment to the City of Miami Beach together
with a violation of this City' s bonded indebtedness incurred by it
solely for the purpose of serving said municipalities .
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA that the City Manager be and he is
hereby authorized and directed to advise the said Water and Sewer
Authority that the City of Miami Beach is totally and vigorously
opposed to any proposal by said Authority to construct the said
additional water main to said outlying municipalities and the City
Attorney be and he is authorized and directed to institute any and
all legal proceedings in order to prevent the construction of said
additional water main and to seek and obtain all financial damages
insuing therefrom.

SUBJECT: WATER SUPPLY FOR THE TOWN OF BAY HARBOR
ISLANDS AND THE VILLAGE OF BAL HARBOUR
The Miami Dade Water and Sewer Authority on July 8, 1977
officially notified the City of Miami Beach that they had been
requested to provide the Town of Bay Harbor Islands and the
Village of Bal Harbour with water supplied by the construction
of the new water main across the Broad Causeway. They had indi-
cated that a feasibility study had been completed and that it
would be in the public interest to have the existing City of
Miami Beach connections to these municipalities remain on a
standby basis after the new transmission line had been installed.
They further notified us that they desired a response prior to
the Authority' s meeting of July 14, 1977. Upon the advice of
the City Attorney, the Administration advised Mr. Garrett Sloan
of the Miami Dade Water and Sewer Authority that the City did
not have sufficient time to evaluate the impact that this pro-
posal might have upon the City' s supply system, in fact, we did
not have the benefit of any feasibility studies that may have
been made and we had no alternative but to vigorously oppose
this proposal and requested that the matter be deferred as the
City was concerned with the millions of dollars invested to
insure an adequate water supply to these municipalities with
some bond issues still outstanding.
The Miami Dade Water and Sewer Authority Board, at its meeting
of July 14, 1977, postponed this matter until its meeting of
August 11, 1977, and on July 19, 1977, forwarded to us copies of
the feasibility studiesthat were made pertaining to this matter.
In reviewing these studies we find that they propose a 30" water
main from the existing main servicing Miami Beach at Northeast
10th Avenue and 79th Street to Bal Harbour via the Broad Causeway,
and that the sizing of this main will not only serve these two
municipalities but will also be capable of servicing the City of
Surfside and Indian Creek Village which are presently served by
the City of Miami Beach.
Attached is a sketch showing the existing water mains servicing
the City of Miami Beach and other immediate areas in the vicinity
of 79th Street together with the proposed water main to Bal Harbour.
The Miami Dade Water and Sewer Authority presently furnishes water
to the City of Miami Beach from its pump station at Northwest
10th Avenue and 67th Street via the 79th Street Causeway, and the
City in turn furnishes water to the municipalities to the north.
However, during peak daily flows the water main on the 79th Street 4
Causeway primarily serves Normandy Isle. The municipalities to •

the north are served from our storage tanks at 75th Street and
Dickens Avenue that have a capacity of nine million gallons.
The Authority' s proposal to allow the proposed 30" main to con-
nect at Northeast 10th Avenue and 79th Street would have an
adverse effect upon the City of Miami Beach water system during
peak flows. The City of Miami Beach, through cost participation,
has contributed its share for the use of the 30" main all the
way to the pumping station at Northwest 10th Avenue and 67th
Street, and we feel it should continue to be used to serve Miami
Beach and the Little River area and not be used to serve Bal
Harbour direct. The Authority services other areas from the
pump station at Northwest 10th Avenue, however, this is by a
separate main.
The City Attorney has reviewed the existing contracts with the
Miami Dade Water and Sewer Authority and has indicated that the
Authority would breach its contract with us if it should supply
these municipalities. Thus, the City would lose its capital
investments for facilities to assure an adequate water supply
to these municipalities and would have to bear the cost of the
outstanding bond issues for these facilities.
Based on the above it is recommended that the Council authorize
the Administration to take action necessary to oppose the ser-
vicing of these municipalities by the Miami Dade Water and Sewer
Authority.
