Resolution 77-15409 RESOLUTION NO. 77-15409 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH CONFIRMING ACCEPTANCE OF GRANT OF NATIONAL ENDOWMENT FOR THE ARTS FOR A MAJOR SCULPTURE TO BE LOCATED IN THE AREA OF NEW CIVIC AND CONVENTION CENTER IN ACCORDANCE WITH REQUEST OF LETTER OF NATIONAL ENDOWMENT FOR THE ARTS DATED AUGUST 1, 1977 . WHEREAS, the City of Miami Beach has been advised by the National Endowment for the Arts, a federal agency, by letter dated August 1, 1977, which letter is attached hereto and incorporated herein by reference, that the City of Miami Beach has been awarded Grant R70-41-62 in the amount of $50, 000 for supporting the com- missioning by the Art in Public Places Committee, Inc. of a major sculpture to be located in the area of the new Civic and Convention Center as outlined in the application of the City of Miami Beach (A13393-76) dated November 29 , 1976, and WHEREAS, it is a condition of said grant that endowment funds provided may not exceed 50% of the total cost of this project, and WHEREAS, the City of Miami Beach is required to confirm the acceptance of said grant and to request initial payment by following the procedure set forth in said letter attached hereto; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that said grant be and the same is hereby accepted in the name of the City of Miami Beach, Florida, and that the proper officials of the City of Miami Beach carry out and execute the provisions and requirements set forth in said letter for the purposes set forth therein; BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Manager of the City of Miami Beach, Florida, be and he is duly authorized and empowered to execute and deliver all documents necessary for the execution of the purposes of this Resolution, for and in the name of the City of Miami Beach. Grant funds are to support the commissioning by the Art in Public Places Committee, Inc. , of a major sculp- ture to be located in the area of the new Civic and Conven- tion Center as outlined in your application (A13393-76) dated November 29, 1976 and correspondence referred to below. The grant starting date is June 1, 1977 and the grant end- ing date is May 31, 1978. It is understood that the grantee is financially, adminis- tratively and programmatically responsible for all condi- tions of the grant. All reports and cash requests must be signed by the authorizing official or the individual dele- gated the authority to act on behalf of the authorizing official of the grantee organization. It is a condition of this grant that Endowment funds pro- vided may not exceed fifty percent of the total cost of this project. The obligation of -the Endowment shall not be increased unless agreed to in writing by the Chairman or her duly authorized representative. A copy of the-General Grant-Provissons—NFAI- 1-54 Revised May 1975 is attached. Please note that allowable costs un- der this grant shall be determined in accordance with the cost principles set forth in the Federal Management Circular No. 74-4. You are further reminded that this grant award requires adherence to Federal Management Circular No. 74-7, "Uniform administrative requirements for grants-in-aid to State and local governments. In all published material and announcements regarding this program it is suggested that a special notice be made that: "This project is supported by a grant from the National Endowment for the Arts in Washington, D.C. , a Federal agency.
