A RESOLUTION AUTHORIZING AND DIRECTING THE CITY
MANAGER TO EXECUTE A CONTRACT BETWEEN THE CITY
AND FLORIDA DEPARTMENT OF STATE, DIVISION OF
LIBRARY SERVICES FOR THE PURPOSE OF RECEIVING
A SUBSIDY FOR JOSE FORNES , LIBRARIAN TRAINEE,
TO ENABLE HIM TO ATTEND GRADUATE LIBRARY SCHOOL
AT ATLANTA UNIVERSITY AND AUTHORIZING AND DIRECT-
ING THE CITY MANAGER TO EXECUTE SIMILAR SUCH
CONTRACTS INVOLVING OTHER LIBRARIAN TRAINEES
WITHOUT THE NECESSITY OF A SEPARATE RESOLUTION
COVERING EACH CONTRACT.
WHEREAS, from time to time, the City Council has authorized
the City Manager to enter into a contract with the Florida Department of
State, Division of Library Services to receive subsidies for students who
are attending graduate library school , and since (1 ) all of these contracts
are the same (except for the names of the individuals) and (2) there is fairly
frequent change in personnel necessitating the signing of new contracts, it is
considered that authorization should be granted the City Manager to execute such
contracts without a separate resolution covering each contract, and
WHEREAS the immediately pending contract involving JOSE
FORMES , Librarian trainee, is in the grope;" form for the accomplizhmsnt
of such purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
MIAMI BEACH, FLORIDA:
Section 1 . The City Manager is hereby authorized and directed
to execute a contract between the City and Florida Department of State, Division
of Library Services for the purpose of receiving a subsidy for JOSE FORNES ,
librarian trainee to enable him to attend graduate library school at Atlanta
University.
Section 2. The City Manager is hereby authorized and directed
to execute similar such contracts involving other librarian trainees without
the necessity of a separate resolution covering each contract.

AGREEMENT BETWEEN
CITY OF MIAMI BEACH, FLORIDA
AND THE
DEPARTMENT OF STATE
DIVISION OF STATE LIBRARY SERVICES
Under theterms of the contract made this 30th day of
September , 19 77 , between the CITY OF MIAMI BEACH , Herein-
Tine of City or County)
after called the CITY , and the Department of State, Division
(City or County)
of State Library Services, hereinafter called the Department, it is agreed
that:
1 . The CITY will :

a. Furnish the Department a certified copy of the
minutes of the meeting of the CITY COUNCIL
(City or County Governing Body)
at which formal action was taken for the library to
participate in the Salary Grant Program under the
Florida State Plan for the Further Extension of
Library Services.
b. Pay to JOSE FORNES a salary grant of
(Name of Trainee)
$3,600 for the purpose of earning a master's degree
in library science at the ATLANTA UNIVERSITY
A.L.A. accredited library school .
c. File with the Department copies of tha agreement
between the trainee and the CITY
(City or County)
stating the salary bracket under which he will con-
tinue employment after the completion of his degree
in library science.
*IF CONTRACT IS MADE BETWEEN DEPARTMENT OF STATE, DIVISION OF
LIBRARY SERVICES, AND LIBRARY BOARD, CITY OR COUNTY MUST FURNISH
DOCUMENTATION OF BOARD'S LEGAL AUTHORITY TO ENTER INTO AND EXECUTE
SUCH AN AGREEMENT.

d. File with the Department a copy of its job classification
and pay plan.
e. Provide assurance that all library services will comply
with Title VI of the Civil Rights Act of 1964.
f. Agree that all funds provided under this contract will
be used only for the purposes set forth herein.
g. Certify to the Department that the trainee has agreed to:
(1 ) Continue employment in this library for two years
after graduation.

(2) Accept employment in another public library in the
state if there is no vacancy on the staff of this
library, and to accept the assistance of the
Department of State, Division of Library Services
in finding suitable employment. It is agreed
that the trainee will not accept a lower salary
than that scheduled for the position in the
contracting library.
(3) Sign a promissory note for the full amount of
the grant used and to repay it if he fails to
complete the program for reasons over which the
Department finds that he has control .
h. Submit an audit report by a certified public accoun-
tant if the library is not subject to audit by the
State Auditing Department.
2. The Department agrees to:
a. Pay the City $ 3, 600 .00
b. Provide supervision, counsel and assistance as needed
for the operation of this program.
c. Provide a written release to the library if there is
no suitable public library opening for a trainee
after graduation.
This contract is binding during the three year Salary Grant
Program. It shall be effective for the period' beginningseptember ,
19 77 . and ending September , 19 80

CONTRACT
�-- THIS AGREEMENT, made and entered into this \.`_. day of
by and between the Miami. Beach Board of Library
Trustees, hereinafter called the Board, and JOSE FORNES , herein-
after called Trainee, WITNESSSTH:
WHEREAS the Board has entered into an agreement with
the Department of State, Division of Library Services to administer a salary grant
program, and
WHEREAS it is necessary that there be an agreement
between the Board and Trainee in order to participate in said program,
now, therefore,
IT IS MUTUALLY AGREED BY AND BETWEEN THE PARTIES
HERETO AS FOLLOWS:
1. Trainee must complete program within three (3)years.
2. Trainee will accept a position in another Florida Public
Library if no suitable position is open in the Miami Beach Public Library System when
he completes his training.
3. Trainee will accept employment in the Miami Beach
Public Library System as a Librarian I , at a salary of $1 057 . per month, if qualified
and selected under the Civil Service laws of the City of Miami Beach for a period of
two years after graduation.
4. Trainee will sign a promissory note to pay the full
amount of the grant used ould Trainee fail to complete the program for reasons
over which the Department of State, Division of Library Services finds that trainee
has control .

6. Trainee agrees to submit record of courses completed
and grades at end of each quarter, semester or course period.
Said grant as it is received will be placed in a trust account of the City of Miami Beach
and thereafter paid to Trainee. The total amount paid for the period of this contract
shall be $3,600.00, no part of which shall come from monies other than the salary
grant given by the Department of State, Division of Library Services.
*NOTE: Trainee cannot be accepted for employment by the library unless
there is a vacancy for a Professional Grade I Librarian and unless
said trainee is selected from the highest three on the appropriate
eligible list of the City of Miami Beach.
The term of this contract shall be for a period beginning the
i at day of September, 1977 and ending on the-6 day of
September, 1980 .
IN WITNESS WHEREOF the parties hereto have duly executed
this Agreement in duplicate the day and year first above written.

year (Fall) 1977 provided you supply the necessary documents
for the required contract with our agency. For your informa-
tion, a sample copy of that contract, along with examples
of appropriate wording for the supporting documents are
enclosed.
All documents should be supplied to us as soon as possible
to expedite this grant. When they have been received and approved,
we shall send you the official contract to be properly executed.
Please be advised that the amount of the grant award will be
forthcoming approximately one month from the time we receive the
signed contract from you.
