A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI BEACH, FLORIDA, ACCEPTING OFFER OF GRANT
OF $3 , 018,000 FROM U. S. DEPARTMENT OF COMMERCE
FOR PROJECT NO. : 04-51-21092 UNDER THE PROVISIONS
OF THE LOCAL PUBLIC WORKS CAPITAL DEVELOPMENT AND
INVESTMENT ACT OF 1976 , AS AMENDED BY THE PUBLIC
WORKS EMPLOYMENT ACT OF 1977 .
WHEREAS, by communication received by the City of Miami
Beach from the Honorable Robert T. Hall , Assistant Secretary for
Economic Development representing the United States Department of
Commerce, the City of Miami Beach has been advised that said
Department of Commerce has made an Offer of Grant to the City of
Miami Beach, pursuant to its application for federal assistance
under the provisions of the Local Public Works Capital Development
and Investment Act of 1976 , as amended by the Public Works Employ-
ment Act of 1977, which said communication is attached hereto and
incorporated herein by reference, and
WHEREAS, the City Council of the City of Miami Beach,
Florida, has determined that it is in the best interest of the
City of Miami Beach, its citizens, residents and taxpayers that
said Offer of Grant be accepted;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor of the City of
Miami Beach, as this City ' s principal official, and the City Clerk
of the City of Miami Beach, as an authorized official other than
said principal official, be and they are hereby authorized and
directed to execute and deliver to the proper officials of the
said United States Department of Commerce an acceptance of said
Offer of Grant as required by said communication from said Assis-
tant Secretary for Economic Development;
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that the City Manager be and he is hereby
authorized and directed to execute and deliver to the proper offi-
cials of the said United States Department of Commerce the required
copies of Form ED-1004, being "Designation of Depository for
Direct Deposit of Grant and/or Loan Funds" and Form SF-1194 , being
"Authorized Signature Card for Payment Vouchers on Letter of
Credit" , for and in the name of the City of Miami Beach;
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that it pledges and covenants its perfor-
mance of the condition of said Grant that on-site labor will
commence earlier than the required 90 days from the date of this
City' s receipt of said Offer of Acceptance;
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, for itself and on behalf of its citizens ,
residents and taxpayers, expresses its very real and profound
appreciation to all the officials of the United States Department
of Commerce for the able and cordial assistance and cooperation
given by them to this City, including the able, talented anci
dedicated attorneys of the said Department of Commerce for their
efforts in this matter.

Dear Mr. Southern:
We are pleased to enclose two signed copies of an Offer of
Grant issued pursuant to your application for Federal assistance
under the provisions of the Local Public Works Capital Develop-
ment and Investment Act of 1976 , as amended by the Public Works
Employment Act of 1977 . The total project cost is based on
the line item estimates contained in Attachment No. 1 hereto.
Your acceptance of the Offer of Grant shall be indicated by
the signature of your principal official on one of the signed
copies. The official ' s signature shall be certified by an
authorized official other than your principal official . Send
the accepted copy to the Director, Southeastern Regional Office,
Suite 700, 1365 Peachtree Street, N.E. , Atlanta, Georgia 30309.
Also, enclosed are two copies each of Form ED-1004 , "Designation
of Depositary for Direct Deposit of Grant and/or Loan Funds , "
and Form SF-1194, "Authorized Signature Card for Payment Vouchers
on Letter of Credit, " which must be completed and forwarded to
the Regional Office in order for you to be issued a letter of
credit. (The issuance of a letter of credit may not be neces-
sary if you have an existing letter of credit from this agency,
or if your total grant funding under this legislation is less
than $120 , 000; in such cases please contact the LPW Letter of
Credit Designee at the Regional Office before completing these
forms. )
You are cautioned not to make any commitments in reliance on
this grant, nor to enter into negotiations relative hereto,
until you have carefully reviewed the terms and conditions and
have determined that you are in compliance or that you can
comply therewith. Any commitments or undertakings entered into
prior to obtaining the approval of the Government in accordance
with its terms and conditions will be at your own risk.

OFFER OF GRANT
Pursuant to its authority under the Local Public Works Capital
Development and Investment Act of 1976 , as amended by the Public
Works Employment Act of 1977 and subject to the Special Conditions
(Exhibit "A" ) and the Standard Terms and Conditions (Exhibit "B-
LPW" ) which are herein incorporated by reference, the Economic
Development Administration, U. S. Department of Commerce
(Government) offers a Grant not to exceed $ 3, 018, 000 to the
City of Miami Beach, Dade County, Florida
(Grantee) to provide financial assistance for construction of a
municipal marina,
(Project ) presently estimated to cost $3,118 ,000
This Offer, the Acceptance, the Special Conditions, and the
Standard Terms and Conditions shall constitute the Grant Agree-
ment. Acceptance of this Offer must be returned to the Economic
Development Administration prior to SEP 2 9 1977
