A RESOLUTION AMENDING RESOLUTION NO. 77-15417,
CALLING THE SPECIAL ELECTION TO BE HELD ON
NOVEMBER 1, 1977, BY DELETING THEREFROM ALL
REFERENCE TO QUESTION NO. 4 , RELATIVE TO THE
PROPOSED INITIATIVE ORDINANCE REPEALING
CERTAIN TAXES .
WHEREAS, the City Council of the City of Miami Beach,
Florida, on August 17 , 1977 , adopted Resolution No. 77-15417 ,
calling a special election to be held on November 1, 1977 , for the
purpose of submitting to the electorate of the City of Miami Beach
two proposed Charter Changes, a proposed Bond Issue, and an
Initiative Ordinance, and
WHEREAS, the City Council of the City of Miami Beach
directed the City Attorney of said City to file a complaint for a
declaratory decree as to the placement of said Initiative Ordi-
nance on said November 1, 1977, ballot, and
WHEREAS, the decree of the Circuit Court of the Eleventh
Judicial Circuit of Florida, in and for Dade County, has been
received, granting the relief sought by the City and has ordered
the City to rescind that portion of the resolution placing said
Initiative Ordinance on said November 1, 1977, ballot;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that said Resolution No. 77-15417
be and the same is hereby amended so as to delete therefrom all
provisions for the placement of said Initiative Ordinance, being
Question No. 4 , on said ballot, and the City Clerk is hereby
ordered to so advise the Metropolitan Dade County Board of
Elections.
