A RESOLUTION TERMINATING CERTAIN LEASE
AGREEMENTS WITH IRVING M. ELLIS, JR. ,
HYMAN SPIEGEL AND SHELDON SPIEGEL.
WHEREAS , IRVING M. ELLIS, JR. , is the lessee under a
written agreement with the CITY OF MIAMI BEACH, whereby the said
ELLIS leases certain premises designated, 1290 - 5th Street and
1310 - 5th Street, Miami Beach, Dade County, Florida, adjacent to
the Chamber of Commerce Docks, together with the existing marine
fueling dock and facilities located south of the Chamber of Commerce
Docks , and slip number one at the Chamber of Commerce Dock, all as
more particularly described in said lease agreement, and
WHEREAS , HYMAN SPIEGEL and SHELDON SPIEGEL, are lessees
of a portion of the Chamber of Commerce Docks under a written
agreement with the CITY OF MIAMI BEACH, and
WHEREAS , said agreements each provide for seventy-five
(75) days notice of termination, and
WHEREAS , the City Manager and the Director of Public
Utilities advised that it is necessary for the City to regain
possession of the premises leased pursuant to the aforementioned
agreements in order to begin construction of the new South Beach
Marine Breakwater;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the agreement between the
CITY OF MIAMI BEACH, as lessor, and IRVING M. ELLIS , JR. , as lessee,
approved by the City Council of the City of Miami Beach on the 3rd
day of November, 1976 , by Resolution Number 76-15182, be and the
same is hereby terminated, and
FURTHER RESOLVED, that the agreement between the CITY OF
MIAMI BEACH, and SHELDON SPIEGEL and HYMAN SPIEGEL, approved by the
City Council of the City of Miami Beach on the 3rd day of November,
1976 , by Resolution Number 76-15183, be and it is hereby terminated,
and
FURTHER RESOLVED, that the aforesaid terminations shall
become effective in accordance with the terms of the said agreements
aforementioned, and
FURTHER RESOLVED, that the City Attorney and the City
Manager be and they are hereby authorized and directed to take all
necessary steps in order to effectuate said termination, and obtain
possession of the subject premises.
