A RESOLUTION AUTHORIZING EXECUTION AND DELIVERY OF
CONTRACT WITH THOMAS J. MERLO AND COMPANY AND THE
CITY OF MIAMI BEACH EMPLOYING SAID CONTRACTOR TO
DEVELOP AND PREPARE A "SEWER USER CHARGE" AND
"INDUSTRIAL COST RECOVERY SYSTEM" AS REQUIRED BY
THE ENVIRONMENTAL PROTECTION AGENCY IN CONNECTION
WITH CONSTRUCTION OF SEWAGE TRANSMISSION SYSTEM
TO VIRGINIA KEY.
WHEREAS, the City of Miami Beach, under its contracts
with the Environmental Protection Agency for the construction of
the sewage transmission and disposal system to Virginia Key, is
required to develop a "Sewer User Charge" and "Industrial Cost
Recovery System" whereby the legally required sewer user charge
may be determined and imposed, and
WHEREAS, the determination of such fees must be in
accordance with mathematical and specialized standards in accor-
dance with public utility practices, and
WHEREAS, the firm of Thomas J. Merlo and Company is
specially qualified to perform said service to the City of Miami
Beach, and
WHEREAS, the employment of said firm will be in accor-
dance with the requirements of the Environmental Protection Agency
and other applicable federal rules and regulations, and
WHEREAS, an appropriate agreement has been prepared
setting forth the services to be rendered by said firm to the City
of Miami Beach at an estimated cost not to exceed Eight Thousand
Seven Hundred Fifty Dollars ($8, 750. 00) based upon an estimated
expenditure of 350 hours, and
WHEREAS, said agreement has been approved as to legal
form by the City Attorney and its execution has been recommended
by the City Manager;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City
Clerk be and they are hereby authorized and directed to execute
the said agreement in the name of and on behalf of the City of
Miami Beach, and the disbursing officers of the City are hereby
authorized and directed to disburse the monies required by the
terms of said agreement from funds of the City available for such
purpose.
