Resolution 77-15514A RESOLUTION NO. 77-15514A A RESOLUTION AUTHORIZING AND DIRECTING THE EXECUTION OF AN AGREEMENT WITH EVERGLADES SOD AND LANDSCAPING, INC. AND P. J. CON- STRUCTORS FOR THE PURPOSE OF SETTLING OUT- STANDING CLAIMS WITH RESPECT TO CONTRACT FOR GRADING AND PAVING NORTH SHORE OPEN SPACE, MP-41. WHEREAS , the City of Miami Beach and Everglades Sod and Landscaping, Inc. entered into a contract for the construction of certain improvements to real property in Dade County, Florida, more particularly identified as Contract for Grading and Paving North Shore Open Space, MP-41, and WHEREAS , P. J. Constructors was a subcontractor of Everglades Sod and Landscaping, Inc. with respect to portions of the work pursuant to said contract, and WHEREAS, there has arisen disputes between the parties with respect to the aforementioned contract concerning the amount and quantity of certain materials provided pursuant to said con- tract, which materials were part of a "unit price" portion of said contract, and WHEREAS, a proposed agreement to settle said disputes has been negotiated between the parties, which provides for the payment to Everglades in the amount of $1, 176 . 53 and furnishing 1979 cubic yards of fill to P. J. Constructors in satisfaction of all claims for additional compensation, and WHEREAS , the City Manager recommends the proposed settle- ment and the City Attorney has prepared an appropriate agreement, the terms of which are before the Commission; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Clerk are hereby authorized and directed to execute the subject agree- ment in the name of the City of Miami Beach for and in its behalf.
