Resolution 79-16114 RESOLUTION NO. 79-16114
A RESOLUTION TERMINATING THE SEWAGE COLLECTION
AND DISPOSAL SYSTEM CONTRACT BETWEEN THE CITY
OF MIAMI BEACH AND THE TOWN OF SURFSIDE.
WHEREAS, the City of Miami Beach operates for the use
and benefit of its inhabitants a sewage collection and disposal
system which has sufficient capacity under suitable conditions
to furnish sewage collection and disposal service to neighboring
municipalities; and
WHEREAS, the City of Miami Beach did in 1972 enter into
a contract with the Town of Surfside wherein the City of Miami
Beach agreed to furnish sewage collection and disposal service
to the Town of Surfside at a rate of six cents ($ . 06) per 1000
gallons of sewerage pumped; and
WHEREAS, said contract contains a termination clause
which provides for termination of contract upon 90 days written
notice;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: The City Commission of the City of Miami Beach, Florida,
pursuant to the terms of the contract entered into
between the parties on the 2nd day of August, 1972, hereby gives
90 days written notice of intention to terminate said agreement.
SECTION 2 : The City Commission of the City of Miami Beach, Florida,
finds and determines that it is in the best interest of
the City of Miami Beach, its taxpayers and citizens to terminate
said contract.
SECTION 3 : That the City Clerk be and she is hereby authorized
and directed to cause a copy of this Resolution to
be delivered to the Mayor and City Manager of the Town of Surfside.
