A RESOLUTION TERMINATING THE SEWAGE COLLECTION
AND DISPOSAL SYSTEM CONTRACT BETWEEN THE CITY
OF MIAMI BEACH AND THE TOWN OF NORTH BAY VILLAGE.
WHEREAS, the City of Miami Beach operates for the use
and benefit of its inhabitants a sewage collection and disposal
system which has sufficient capacity under suitable conditions
to furnish sewage collection and disposal service to neighboring
municipalities; and
WHEREAS, the City of Miami Beach did in 1967 enter into
a contract with the Town of North Bay Village wherein the City
of Miami Beach agreed to furnish sewage collection and disposal
service to the Town of North Bay Village at a rate of twenty-five
cents ($ . 025) per 1000 gallons of sewerage pumped; and
WHEREAS, said contract contains a termination clause
which provides for termination of contract upon 90 days written
notice;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: The City Commission of the City of Miami Beach, Florida,
pursuant to the terms of the contract entered into
between the parties on the 19th day of January, 1967 , hereby gives
90 days written notice of intention to terminate said agreement.
SECTION 2 : The City Commission of the City of Miami Beach, Florida,
finds and determines that it is in the best interest of
the City of Miami Beach, its taxpayers and citizens to terminate
said contract.
SECTION 3 : That the City Clerk be and she is hereby authorized
and directed to cause a copy of this Resolution to
be delivered to the Mayor and City Manager of the Town of North
Bay Village.
PASSED and ADOPTED this 5th day of December , 1979 .

SUBJECT: TERMINATION OF SEWAGE COLLECTION AND DISPOSAL
CONTRACTS WITH SATELLITE CITIES
Attached are four separate resolutions which terminate existing contracts
for sewage collection and disposal between the City of Miami Beach and the
municipalities of North Bay Village, Bal Harbour Village, Surf side and Bay
Harbor Islands.
Two of the contracts provide for collection and disposal at a rate of 25% per
thousand gallons of sewage pumped. The others provide for a rate of per
thousand gallons.
The contracts are being terminated on 90 days notice due to the upcoming
connection of the sewage system of the City of Miami Beach to the Virginia
Key Treatment facility.
As the Commission is aware, the connection to the Virginia Key facility will
make it impossible for us to continue to serve these cities at the current
rates. The termination of the contracts does not mean that we will stop
providing service to the cities. It simply means that service will continue on
a month to month basis until new rates are established under the appropriate
rate setting procedure and after our costs are known for operation under the
new system.
Since we anticipate connection to the Virginia Key facility as early as March
or April of 1980, it is important that the required 90 day notices be given at
this time.
RECOMMENDATION
It is recommended that the attached resolutions terminating the contracts
for sewage collection and disposal with the municipalities of North Bay
Village, Surf side, Bal Harbour Village and Bay Harbor Islands be adopted.
